Local Law No. 8 - 2011
This local law shall be known as the “Update of Fees charged for Services provided by,
Applications made to and Licenses and Permits issued by the Town of Mamaroneck” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
The fees charged by the Town for services it provides, the applications which it entertains
and the licenses or permits which it issues are contained in numerous provisions throughout the
Town Code as well as in Chapter A250 which is entitled FEE SCHEDULE. The Town Board has
determined to consolidate the fees onto one schedule so that the public need look in only one place
in order to find the Town’s fees. To do so, this law revises Chapter A250 and adds, amends or
repeals provisions of the Town Code.
Section 2 – Amendment of a current section of the Mamaroneck Code:
Section A250-1 of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:

Section 3 – Amendment of a current subsection of the Mamaroneck Code:
Section 1-11 D. of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:
§1-11. Changes in previously adopted legislation; new provisions.
D. Fees.
The fees for services provided by, applications made to and licenses or permits
issued by the town pursuant to the Code are as set forth in section A250-1.
Section 4 – Amendment of a current section of the Mamaroneck Code:
Section 32-3 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§ 32-3 Fee.
The fee to be paid to the Town of Mamaroneck for each such escort service shall be as set
forth in section A250-1. All fees for such escort service shall be paid to the Town
Comptroller of the Town of Mamaroneck, New York.
Section 5 – Repeal and re-enumeration of current subsections of the Mamaroneck Code:
Section 50-3 C. of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:
§50-3. License required; application; fees.
C. License and permit fees. Annual license and user permit fees shall be as set forth in
section A250-1.
Section 6 – Amendment of a current subsection of the Mamaroneck Code:
Section 50-4 D (1). of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:
§50-4. Responsibility for systems; equipment; false alarms.
D. False alarms.
(1) Any owner or lessee of property having an alarm device or system of devices on his,
her or its premises and any user of any services or equipment furnished by a licensee under
this chapter shall pay to the Town of Mamaroneck, upon demand, the charge set forth in
section A250-1for false alarms to which Police Department or Fire Department personnel
responds.
Section 7 – Amendment of a current subsection of the Mamaroneck Code:
Section 55-6 A. of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:
§ 55-6. License fees; terms.
A. Every applicant, before being granted a license, shall pay (1) the annual license fee for
the privilege of operating or maintaining for operation each mechanical amusement
device, as defined in §55-1 herein, and (2) the separate annual license for maintaining
premises that contain said devices that are set forth in section A250-1.
Section 8 – Amendment of current subsections of the Mamaroneck Code:
The number “A250-1 A.” that appears in sections 58-7 A. and 58-7 G. is changed to read:
“A250-1”.
Section 9 – Amendment of a section of the Mamaroneck Code:
The number “A250-1 A.” that appears in section 58-8 is changed to read: “A250-1”.
Section 10 – Amendment of a section of the Mamaroneck Code:
Section 82-4 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§82-4. License fee.
The fee for such license to be paid at the time of issuance shall be as set forth in section
A250-1 but if the application is for a period of six months or less, the fee shall be 1/2 the
yearly fee.
Section 11 – Amendment of a current subsection of the Mamaroneck Code:
Section 95-30 A. of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§95-30. Fees or Deposits.
A. Upon the filing of an application for a Surface Water and Erosion Control Permit or
a Stormwater Pollution Prevention Plan, the fess set forth in section A250-1shall be
paid, except that no fee shall be required if the Stormwater Management Officer
waives the separate permit requirement in accordance with §95-9. If work is
commenced prior to the issuance of a required permit, all fees for the project shall be
doubled.
Section 12 – Amendment of a current section of the Mamaroneck Code:
Section 106-56 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§106-56. Fees.
The fee for a service provided or a license or a permit issued pursuant to this Chapter is as
set forth in section A250-1.
Section 13 – Amendment of a current section of the Mamaroneck Code:
The first sentence of section 114-7 A. (1) of the Code of the Town of Mamaroneck hereby
is repealed and the following substituted in its place:
§114-7. Wetlands permits.
A. Permit applications.
(1) Any person proposing to conduct or cause to be conducted a regulated activity as
defined in §114-5 shall file an application for a permit in duplicate with the Building
Department and pay the filing fee set forth in section A250-1.
Section 14 – Amendment of a current section of the Mamaroneck Code:
Section 117-6 of the Code of the Town of Mamaroneck hereby is repealed and the
following substituted in its place:
§117-6. License Fee.
The fee for a license or a permit issued pursuant to this Chapter is as set forth in section
A250-1.
Section 15 – Repeal of a current subsection of the Mamaroneck Code:
Section 147-5 B. hereby is repealed, the “A.” in section 147-5 hereby is removed and the
title of section 147-5 hereby is changed to: “Special permit parking areas.”
Section 16 – Amendment of a current section of the Mamaroneck Code:
Section 147-8 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§147-8. Fees.
The fee for a permit issued pursuant to this Chapter is as set forth in section A250-1.
Section 17 – Amendment of a current section of the Mamaroneck Code:
Section 154-7 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§154-7. License fees.
The fee for a license issued pursuant to this Chapter is as set forth in section A250-1.
Section 18 – Amendment of a current section of the Mamaroneck Code:
Section 158-6 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§158-6. Fees.
The fee for a service provided or a license or a permit issued pursuant to this Chapter is as
set forth in section A250-1.
Section 19 – Amendment of a current subsection of the Mamaroneck Code:
Section 167-8 B of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§167-8. Fees.
B. The fee for making copies is as set forth in section A250-1.
Section 20 – Amendment of a current subsection of the Mamaroneck Code:
Section 175-8 C. of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§175-8. Application for permit.
C. An application for a sign permit must be accompanied by the filing fee set forth in
section A250-1.
Section 21 – Adoption of a new section to the Mamaroneck Code:
The Code of the Town of Mamaroneck is amended to include the new section 175-17 set forth
below:
§175-17. Fees.
The fee for a service provided or an application made pursuant to this Chapter is as
set forth in section A250-1.
Section 22 – Amendment of a current section of the Mamaroneck Code:
Section 177-15 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§177-15. Fees.
Every application for site plan approval shall be accompanied by the fee set forth in
section A250-1. Should an agency of the town having jurisdiction over an application deem
it necessary to hire consultants for technical review and/or on-site inspection, the applicant
shall be required to pay the actual cost to the town for such services.
Section 23 – Amendment of a current section of the Mamaroneck Code:
The last sentence of section 187-5 of the Code of the Town of Mamaroneck hereby is repealed and
the following substituted in its place:
An application for a permit must be accompanied by the fee set forth in section A250-1,
made payable to the Superintendent of Highways.
Section 24 – Adoption of a new article to a chapter of the Mamaroneck Code:
The Code of the Town of Mamaroneck is amended to include the new article IV to Chapter 190 of
the code set forth below:
ARTICLE V – FEES. (§190-22)
§190-22. Fees.
The fee for a service provided, a license or a permit issued or an application made pursuant
to this Chapter is as set forth in section A250-1.
Section 25 – Amendment of a current section of the Mamaroneck Code:
Section 198-3 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§198-3. License fees.
The fee payable to the Town Clerk for each taxicab license and private livery license is as
set forth in section A250-1.
Section 26 – Amendment of a current subsection of the Mamaroneck Code:
Section 198-7 B. of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§198-7. Expiration of licenses; replacement fee.
If a license or badge issued in accordance with this chapter is lost, the holder thereof may
obtain a new license or badge upon application to the Town Clerk and the payment to the
Town Clerk of the fee set forth in section A250-1.
Section 27 – Amendment of a current subsection of the Mamaroneck Code:
The last sentence of section 207-6A. of the Code of the Town of Mamaroneck hereby is repealed
and the following substituted in its place:
The fee for each application is as set forth in section A250-1and is payable upon
submission of the application.
Section 28 – Amendment of a current subsection of the Mamaroneck Code:
The first sentence of section 226-4A. of the Code of the Town of Mamaroneck hereby is repealed
and the following substituted in its place:
If the Town impounds a motor vehicle pursuant to this chapter, the owner may redeem the
same from the Police Department upon the payment of the fine, plus the storage fee for each
day or fraction thereof that the vehicle is stored by the Police Department, which are as set
forth in section A250-1.
Section 29 – Amendment of a current subsection of the Mamaroneck Code:
Section 240-61A. of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§240-61. Applications; fee.
A. An application for a special permit shall be made to the Planning Board. Such
application shall be accompanied by a fee as set forth in section A250-1and shall be
on a form prescribed by the Planning Board requiring the following information:
(1) The name of the applicant and owner of the property.
(2) The location of the property, intersecting streets and the Tax Map description.
(3) The present use at the proposed location for the special permit.
(4) The proposed use at the location for the special permit.
(5) Any construction which will be required.
(6) A list of all other permits or applications which must be made by the applicant
in order to proceed with the use.
(7) The signature of the applicant, with a certification that the information contained
in the application is true.
Section 30 – Amendment of a current section of the Mamaroneck Code:
Section 240-91 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§240-91. Fees.
Any person or corporation, other than the Town of Mamaroneck, making any application to
the Board of Appeals under the provisions of this chapter shall pay to the Director of
Building Code Enforcement and Land Use Administration the fees, set forth in section
A250-1, for both processing the applications and advertising the notice of hearing for each
application filed.
Section 31 – Amendment of a current chapter of the Code of the Town of Mamaroneck:
Chapter A250 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:

§A250-1 Enumeration of fees.
The schedule of fees and deposits for services, applications, permits and licenses is as follows:

Section 3 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.
