BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Abby Katz, seconded by Councilwoman Elkind Eney, the Work Session was unanimously opened at 5:00PM. Police Department Mutual Aid Plan Additionally Present: Lt. Paul Creazzo The Town Board reviewed Westchester County’s Mutual Aid and Rapid Response Plan Inter Municipal Agreement (IMA), and received an overview from Lt. Creazzo. Through these IMA’s Westchester County Police and local Departments can request from and render mutual aid to each other. There are no changes to the plan since it was last approved five years ago. Mr. Maker stated that he had read the agreement and had no issues with it. OUT OF ORDER Residential Site Plan Review The Town Board continued their discussion of a residential site plan review law. Mr. Altieri stated that there were approximately six applications currently under review by the Building Department and suggests the Board consider a short term moratorium, adding since we are going into winter development may be slower. Councilwoman Elkind Eney opposes moratoriums. As a Village of Larchmont Trustee she saw the negative effect it can have on real estate. The Board discussed the pros and cons and determined it was in the best interest to move forward with a moratorium. Mr. Maker will prepare legislation for the Board to discuss and possibly set a public hearing at the next Town Board Meeting. The Town will also move forward with inviting the Chairs of the Land Use Boards to come and discuss this legislation. Lisa Siegel, resident of Murdock Woods asked the Board what the top five goals would be for a site plan review process, asking would this include a review of the Floor Area Ratio (FAR) Law. Supervisor Seligson responded and stated that this would not include an FAR review. Ted Weingarten addressed the Board and asked them to consider a Board of Architectural Review (BAR). Supervisor Seligson responded that the Board has discussed this in the past and is not in favor of a residential BAR. Ms. Siegel encouraged the Board to revisit the FAR. Update – Pace University – Green Code Project 2 November 18, 2015 Supervisor Seligson reminded the Board that in 2013 Pace University received a grant to work with four municipalities on greening their codes. Currently there is a report for the municipalities to review, but Supervisor Seligson suggests the Town Department review it first. Supervisor Seligson recapped the green projects the Town is currently working on. Specifically the Community Choice Aggregation proposal is still in draft form and Supervisor Seligson suggest it not come back to the Board until it is more complete. Mr. Maker suggests that the three municipalities that are specifically working on the final document continue to do so as somewhat of a test group, then give it to other municipalities for review. As for the municipal solar buyers group Supervisor Seligson believes that what is being asked of the Town is an IMA that will allow them to go to bid. The Village of Croton passed this and now awaits an opinion from the State. Finally, Supervisor Seligson updated the Board on the micogrid by reminding the Board of the 100K grant to study the feasibility. It does in fact look feasible, so there will be more discussion of this in the future. Sustainability Collaborative 2016 Budget Additionally Present: Mitch Green, Chair Sustainability Collaborative Mr. Green recapped the Committee’s work from 2015. Mr. Green stated that of the $25,000 budgeted in 2015, only $2,000 has been used to date. Mr. Green is requesting to use $3,000 to pay for an intern to update the Utility Tracker software with the remainder of the energy invoice so it will be up to date and relevant. The date is useful to see seasonal fluctuations, spikes in usage, as well as to compare the Town to other municipalities. Supervisor Seligson added that you can’t measure what you don’t know. Mr. Green distributed the 2016 Goals, Programs & Budget, noting that a major focus for the upcoming year will be outreach. The Town Board reviewed the goals and priorities in detail. The Board added to the priority list, legislation to limit decibels for leaf blowers. Review - Tax Cap Override Legislation The Town Board reviewed the legislation ADDED ITEMS The Town Board reviewed and discussed the Easement. The word ‘remedy’ was added to the last paragraph. Councilwoman Katz noted that at the last Traffic Committee Meeting there was discussion of traffic issues along East Hickory Grove Drive. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT Congratulations to the Mamaroneck High School Field Hockey Team for winning the State Championship for the second year in a row! That is a terrific accomplishment. The Town Board continues to work on the 2016 budget which is due in December. Leaf collection continues in the Town. Please remember not to put any material but leaves in the leaf piles as the County will not accept other material with the leaves. th The Town will have to close the top floor of the parking garage on Myrtle Blvd beginning November 27 for a week for repairs. The top floor has breaks in the protective membrane causing leaks to the cars on the floor below. I participated on a panel discussing the elimination of plastic bags that was reported in the Journal News. I attended and participated in the many Veterans Day events in the community, thank you for your service. Ernie and I went to Stratford, CT for the Long Island Sound Futures Fund Grants Announcements. 3 33 November 18, 2015 The Town received a $150,000 grant to include Green Infrastructure in the renovation of the Town Center parking lot. That means we will remove or treat hundreds of thousands of gallons of stormwater runoff helping water quality in the West basin of Mamaroneck Harbor across the street from the Town Center. The US Senators and Representatives from CT attended the grant announcement event. The Town’s award was the largest award given this year and was rated the highest out of the 68 applications received. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. New York State Legislative Update – Senator George Latimer Senator Latimer addressed the Town Board and residents’ of the Town with his legislative update. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open. Murphy There being no business to come before the Commission, on motion of Commissioner Murphy, seconded by Commissioner Odierna, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1.Adoption – Westchester County Police Mutual Aid Plan On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved, WHEREAS, the Town of Mamaroneck has for many years participated in the Westchester County Mutual Aid and Rapid Response Plan, based on Section 209-m of the New York State General Municipal Law, and WHEREAS, through this Intermunicipal Agreement the Westchester County and local Police Departments can request from and render mutual aid to each other in the form of personnel, equipment and supplies when requested. NOW THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the Westchester County Mutual Aid and Rapid Response Plan Inter Municipal Agreement beginning July 31, 2015 and ending July 30, 2020, and BE IT FURTHER, 4 November 18, 2015 RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 2.Authorization – Con Edison Easement – Town Center Building On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the following was approve, WHEREAS, Con Edison has been working with the School District and the Town for the installation of a new technology electric service transformer that is more resilient, and WHEREAS, the new transformer will be located on Boston Post Road adjacent to the Mamaroneck High School football field, and require conduit and wiring to be placed along Town Center property. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Town Board does hereby approve the Easement Agreement between Con Edison and the Town of Mamaroneck, and BE IT FURTHER, RESOLVED, that the Town Administrator is hereby authorized to execute said easement agreement on behalf of the Town. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 3.Amendment – Town Procurement Policy – “Piggy Back Contracts” On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved, WHEREAS, Subdivision 16 has been added to the General Municipal Law (GML) 103 to authorize political subdivisions to award purchasing contracts based upon the use of “piggybacking” as defined in law. NOW, THEREFORE, BE IT RESOLVED, that pursuant to GML (103), the Town Board of the Town of Mamaroneck hereby amends Chapter 3 of the Town of Mamaroneck Administrative Manual “Purchasing Procedures” to allow purchases through the use of “Piggybacking Contracts” , where those contracts have been competitively bid and meet requisite requirements for a “piggyback contract”, and BE IT, FURTHER, RESOLVED, that the resolution be included in Chapter 3 of the Administrative Manual. 5 November 18, 2015 The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 4.Set Public Hearing – Tax Cap Override Legislation On motion of Councilman Murphy. Seconded by Councilwoman Elkind Eney, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on the “Override the tax levy limit established in General Municipal Law 3-c” Law, for December 2, 2015, at 8:00PM in the Court Room of the Town Center, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 5.Consideration of Certiorari On motion of Councilman Odierna, seconded by Councilman Murphy, it was RESOLVED, that the Town Board hereby authorizes the settlement of the following tax certiorari on the following terms: La-Vine Realty Co., LLC Address: 1008-1044 Mamaroneck Avenue Block: 816 Lot: 70 Town of Mamaroneck/Village of Mamaroneck Year Current Assessment Reduction Reduced Assessment 2013 $4,035.000 $1,305,000 $2,730,000 2014 $4,035.000 $1,305,000 $2,730,000 2015 $4,035.000 $1,305,000 $2,730,000 The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye WRITTEN COMMUNICATIONS None REPORT OF COUNCIL 6 November 18, 2015 Councilwoman Elkind Eney and Councilman Odierna attended the Mamaroneck Chamber of Commerce thth Breakfast on November 5, and following that a farewell breakfast for Joanne Aquilino. On November 6 th Councilwoman Elkind Eney attended the Women’s Club New Member Luncheon. On November 7 she and Councilwoman Katz participated in the Town of Mamaroneck Ladies’ Bingo Night, adding what a fun night! The following morning they both attended the Skate for Free with Ron Greschner at the Hommocks Ice Rink, adding what a great event this was. Councilwoman Elkind Eney along with her fellow Board Members attended th many Veterans’ Day events. On November 10, Councilwoman Elkind Eney also attended the Larchmont Chamber of Commerce meeting at which among other things they discussed the Larchmont Street Scape Project as well as upcoming holiday events, specifically the Shop Local Event. Westchester Municipal Officials Association Dinner hosted by the Village of Pelham Manor at Pelham Country Club, the topic was State th Environmental Review (SEQR) an interesting and topical presentation. On November 13 she attended the Larchmont Fire Department Inspection Dinner at the Larchmont Yacht Club and lastly, the Summit meeting which addressed development in the Village of Mamaroneck, including the Hampshire Country Club. Happy 90th Birthday to Emmy Lois Sleeper! Councilwoman Katz noted her attendance at the Town hosted Laserfiche User Group, noting it was an informative meeting and nice to see the Town as a leader in this field. Councilwoman Katz attended the recent Traffic Committee Meeting, noting that a constant issue and complaint among our residents is that people drive too fast. Councilwoman Katz encouraged everyone to slow down and give yourselves time to get to where you are going. Councilwoman Katz announced that the Food Pantry will holding its annual food drive at the Stop and Shop Store. Councilman Odierna attended many of the same events. Of special note was the Kemper Memorial Veterans’ th Day Ceremony. On November 15 Councilman Odierna attended the Fall A ’Capella Festival at Mamaroneck High School, what a wonderful event. Councilman Odierna commended Dena Madden for the excellent work she does with the students. Councilman Murphy wanted to mention the passing of Walter Rogers, a Deputy Mayor and Trustee in Rye Neck as well as former school board member. Mr. Rogers was a resident who cared deeply for the Village of Mamaroneck, a man who did a lot of good for a very long time.
