MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON NOVEMBER 4, 2015, BEGINNING AT 5:00PM
IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was
unanimously opened at 5:00PM.
Update – New York Prize – Microgrid Project
The Town Board reviewed a memo from Mr. Altieri dated November 4, 2015, in which he reminded the Town
Board that the “Town was awarded a grant in the amount of $100,000 for the preparation of a feasibility
study to establish a microgrid under what is known as the NY Prize Program funded by NYSERDA.” Currently
the study is being prepared by Booz, Allen and Hamilton Consulting out of Washington, DC. The study is
focusing on a micro grid for the Town Center, Mamaroneck High School and Sarah Neuman Nursing Home.
The Town Board reviewed a map of the proposed microgrid. The memo from Mr. Altieri outlines the details
of the feasibility study, components of the microgid and the timing of the project. Supervisor Seligson noted
that members of the Sustainability Collaborative who worked on the application for the grant, have been in
contact with Booz, Allen and Hamilton to give their knowledge to the project. A final report is expected in
February of 2016.
Municipal Solar Buyers Group
Supervisor Seligson stated that Mr. Maker has reviewed the agreement, specifically addressing the issues
discussed at the last worksession regarding competitive bidding versus issuing an RFP with a ‘piggy back’
clause. Mr. Maker advises that there is no general municipal law requirement for competitive bidding
because the purchase is power/energy and not a tangible product. Additionally, the Town would not own
the solar panels. It is still unclear as to whether the Town under this agreement, would be required to
purchase the power generated by the solar panels. The Town Board deferred the discussion of the IMA.
Update – Community Choice Aggregation
Supervisor Seligson reported that a new draft agreement is still being worked. Supervisor Seligson also noted
that there is a draft IMA being prepared, adding that it needs additional work by Sustainable Westchester
before it comes to the Town Board for approval. Councilwoman Elkind Eney asked if Mr. Altieri received the
input from bond counsel, and Mr. Altieri responded not as yet.

Discussion - Residential Site Plan
There were residents of Murdock Woods in attendance.
Supervisor Seligson noted that the Town has received a lot of correspondence from residents regarding this
issue.
The Town Board reviewed the section of the New York State Town Law regarding standards for granting area
variances, and a copy of the Town’s Site Plan Review Law. Councilwoman Katz added that Mark Godick, Chair
of the Coastal Zone Management Commission, should be included in the discussion with the Land Use Boards.
The Town Board heard from Mr. Maker regarding the section of the NYS Town Law that he chose for
discussion, as it seemed to reflect the questions and concerns of the Town Board and the residents. The Town
Board also reviewed the Town’s Chapter 177 and discussed pros and cons of legislating a residential site plan
review process. Supervisor Seligson asked the Town Board to consider whether they would like to also review
the Town’s Blasting Law as part of these discussions. Mr. Maker will draft legislation for Town Board review
at an upcoming worksession.
Audrey Weingarten, a resident of Murdock Woods, addressed the Board with an impassioned plea for the
Board to address the concerns of the residents.
New Business
Councilwoman Elkind Eney asked Mr. Altieri if the Home Rule Legislation for Baldwin Avenue was submitted,
and Mr. Altieri responded yes.
Update – Washington Square Sidewalk Project
Supervisor Seligson stated that she spoke with Ralph Engel regarding his grant to the Town, specifically
asking Mr. Engel to clarify what he agrees to fund. Councilwoman Elkind Eney also discussed with Mr. Engel
what he was agreeing to fund, which appears to differ slightly. Supervisor Seligson will ask Mr. Engel to put
clarification in writing so it will be clear to the Town Board moving forward.
ADDED ITEM
Hampshire Property
Mr. Altieri stated that the Town received documents from the recent scoping session held by the Village of
Mamaroneck Planning Board. Mr. Altieri thinks it makes a case for the Town hiring a professional
consultant. It is still unclear whether the Town’s role is one of involved agency or interested agency, and
the Town Board discussed the pros and cons of each. Mr. Altieri reminded the Town Board of the RFP that
was discussed at the previous worksession to hire a consultant to review the SEQR, attend all meetings of
the Village of Mamaroneck Planning Board, and review the impact statement. Mr. Altieri sent the RFP out
to a few companies, noting that the list is short due to a number of firms with conflict of interest. Mr.
Altieri will work on an initial draft response for submission to the Village of Mamaroneck Planning Board.
Mr. Altieri reported that Anna Danoy is working on a community services response to the closing of the
grocery store on Mamaroneck Avenue with respect to the seniors being effected. Ms. Danoy would like to
provide a shuttle for the seniors in the Senior Center Program to an alternative grocery store.
The Town Board discussed the repairs to the parking deck on Myrtle Blvd and N. Chatsworth Avenue. Mr.
Altieri sent a memo to the Town Board explaining that for quite some time water has been seeping through
the upper deck membrane causing leaking onto the lower level of the deck. Mr. Altieri explained that
membranes do wear out over time and what the deck is experiencing at this time is not unusual. This item
was added to Affairs of the Town for this evening.

On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Board unanimously agreed
to enter into an Executive Session to discuss Employment History of a particular persons, Litigation with
Save the Sound, and Employment History regarding the Fire Department.

to resume the Regular Meeting.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:00 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents’ are welcomed to attend.
SUPERVISOR’S SUMMARY REPORT
Congratulations to my fellow Town of Mamaroneck elected Councilwoman Abby Katz, Councilman
Tom Murphy, Town Clerk Christina Battalia and Town Justice Jean Marie Brescia for being re-
elected. I look forward to working with all of you. Congratulations to Norman Rosenblum and Lou
Santoro on being re-elected to the positions of Mayor of the Village of Mamaroneck and Trustee,
respectively. We look forward to continuing to work with them. Congratulations to Catherine
Parker on being re-elected to the position of County Legislator. We look forward to our continued
work with her as well.
We’ve begun our budget review process and have met several times. Town Administrator Steve
Altieri presented the Town Board with a very tight 2016 Tentative budget that calls for a tax levy
increase of 1.7 %. Believe it or not that is actually above the allowable tax levy increase of 1.14 %
under the State imposed tax cap. I’ve been on the Town board for 16 years and 1.7% is the lowest
increase we’ve ever considered. The Tentative Budget is on the Town’s website at
www.townofmamaroneck.org. The calendar of budget meetings is there also. Our next budget
meeting is Wednesday November 11 from noon to 3:00 pm in Conference Room D.
The Town has been watching the beginning phases of review of the proposed development at
Hampshire Country Club and is considering hiring consultants to assist the Town’s review primarily
focused on storm drainage and traffic. Seven acres of the property are in the Town of
Mamaroneck.
There have been many Town and community events the past 2 ½ weeks that I’ve had the pleasure
to attend, but I will let the other board members recount most of them during their Reports of
Town Council. One special event was the opening of the Mamaroneck Self Storage building built
by the Murphy Brothers in the Village of Mamaroneck. The building has substantial “green”
elements resulting in using less than 60% of the energy needed for a similar building. The Emelin
th
Theatre Gala on October 29 was also a special event. I will remind residents that I am on the
Executive Committee of Sustainable Westchester that meets every two weeks, the board of
Westchester Joint Water Works that meets every two weeks, and the Executive Committee of the
Westchester Municipal Officials Association that meets monthly.

Commissioner Elkind Eney reminded residents that with daylight savings comes a reminder to change the
batteries in our smoke and carbon monoxide detectors.

reconvened.

Parking Deck at 175 Myrtle Boulevard” project.
NOW, THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby award a contract to the lowest
bidder, MAARV Waterproofing, Inc., of Clifton, NJ, for repairs to the Myrtle Boulevard Parking
Deck at a cost of $29,950, and

REPORT OF COUNCIL
Councilman Murphy noted the upcoming Veteran’s Day Ceremony held each year at the American Legion,
Post 90, on Prospect Avenue. It will be held at 11:00 am. This is a very nice service in tribute to our
Veterans’.
Councilman Odierna noted that the Town Board has been busy with Budget Meetings. Councilman Odierna
attended the grand opening of the new storage facility in the Village of Mamaroneck, as well as the
wonderful and very well attended, Larchmont Gardens’ Civic Association’s annual Halloween Parade.
Councilwoman Katz attended the Summit Meeting, the topic was Drug Use in Our Community, adding it
appears drug use is down. She also attended a workshop on removing barriers to solar permitting as well a
workshop by Complete Streets. Councilwoman Katz reminded residents that the Town passed a resolution
a number of years ago supporting the Complete Streets program. Councilwoman Katz, as did other Town
Board Members, attended the Oktoberfest at the Senior Center, as well as the Open House at the Weaver

Street Fire House. Councilwoman Katz thanked Katlin Cantwell for her hard work organizing the Larchmont
Gardens’ Civic Association’s Halloween Parade. Councilwoman Katz announced the coat drive taking place
at the Community Resource Center on 134 Center Avenue. Congratulation to the Girls Field Hockey Team
on being the Section 1 Champions.
Councilwoman Elkind Eney attended the Summit Meeting as well, noting it was well attended, noting the
report that drug use is down in our community. Councilwoman Elkind Eney attended the Planned
Parenthood Gala. Councilwoman Elkind Eney thanked the Fire Department for putting on another
wonderful Open House Event. Councilwoman Elkind Eney also attended the self-storage facility opening,
and unfortunately she is not at the Planning Board meeting as it is being held this evening, but hopes to
attend after the end of this Town Board Meeting.
Mr. Altieri reminded residents to not mix grass clipping, sticks, planting, etc. in the leaf piles or they will not
be picked up.
