HomeMy WebLinkAbout2017_12_20 Town Board Minutes December 20, 2017 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON DECEMBER 20, 2017, BEGINNING AT 5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the Work Session was unanimously opened at 5:00PM. Weaver Street Fire House - Apparatus Floor Reinforcement th The Town Board reviewed the memo from Mr. Altieri dated December 15, in which he discusses the bids received. The Board also reviewed a letter from the Town's consulting engineer for the project, Grigg & Davis Engineers, P.C., comparing the two bids received and some of the factors that effected the pricing of the project. The estimates received were higher than expected, therefore, the basement renovation will not be included in the project at this time. Awarding of a bid contract is on the agenda for the Fire Commission this evening. Update - Contract for Fire Department Ladder Truck Mr. Altieri gave an update on the discussions taking place with KME, the manufacturer for the new fire apparatus that was sent back by the Fire Department for repairs. KME has offered the Town $20,000 in compensation as well as an extension of one year to the warranty. Mr. Altieri stated that this is unacceptable to the Town, and the Town is reserving its right to seek damages. On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to enter into an Executive Session to discuss potential litigation with KME and the appointment of Building Inspector. Sabrina Fiddelman was invited into the Executive Session. 1 December 20, 2017 EXECUTIVE SESSION Litigation with KME Appointment of Building Inspector On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to resume the Regular Meeting. ADDED ITEM Town Signage The Town Board asked Mr. Altieri to get additional pricing for signs that are located along the road when entering the Town. TAKEN OUT OF ORDER LMC-TV Update Councilwoman Katz gave an update on the recent LMC-TV Board of Control meeting. She asked the Town Board to consider what the process is for the use, by LMC-TV, of Capital funds generated by PEG monies, that are not distributed to municipalities. Additionally, Councilwoman Katz stated that the discussion of the use of the franchise fees needs to be revisited because the Town did not approve waiving the disbursement of these funds by LMC-TV to the Town. Councilwoman Katz requested from LMC-TV their Minutes. Community Solar Project The Town Board continued their discussion of a concept whereby solar panels, provided by a solar power developer, would be installed on the Hommocks Ice Rink roof. The Town would receive rent from the developer and the power generated would be credited to the electric bills of the tenants of the Hommocks Apartments. The Chairman of the Housing Authority will be attending a January Town Board meeting to discuss the plan. The memo provided by Mr. Altieri, dated December 15th identified the next steps. Review - 2018 Sewer Rent Fee The Town Board reviewed the paper work and the proposed rate prior to this evening's public hearing. ADDED ITEM 2 December 20, 2017 Contract of Sale - Town of Mamaroneck and 16 N. Chatsworth Avenue The Town Board reviewed a proposed contract of sale for the strip of land known as Old Jefferson to 16 N. Chatsworth Avenue. The Town Board had comments and corrections to the document and will review this further at an upcoming Town Board meeting. ADDED ITEM Review of GAR Renewal Agreement The Town Board reviewed the work to be done by GAR Associates with respect to assessments, specifically Mr. Altieri explained the work to be done in the fourth year which will include a Town wide reassessment. The approval of this agreement is on the regular agenda for this evening. There was a correction to the memo and Mr. Altieri is requesting that the agreement be approved for the years 2018, 2019 and 2020. On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, The Board unanimously agreed to a closed session to receive advice of Counsel. ADVICE OF COUNSEL On motion Councilman Odierna, seconded by Councilwoman Elkind Eney, the Town Board unanimously agreed to resume the Worksession. On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the Town Board unanimously agreed to enter into an executive session to discuss appointments to boards and commissions. Sabrina Fiddelman was invited into the executive session. EXECUTIVE SESSION Appointments to Boards and Commissions On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the Town Board unanimously agreed to resume the Worksession. ADDED ITEM The Town Board added three upcoming meetings onto the calendar. At these meetings a motion will be made to consider entering into an executive session to discuss an appointment to the Town Board. The thth meetings were scheduled for January 2nd at 5:30PM, January 6 at 10:00AM and January 8 at 5:30PM. 3 December 20, 2017 CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. PUBLIC HEARING (S) – 2018 Sewer Rent Rate The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on December 6, 2017 a Public Hearing will be held on Wednesday, December 20, 2017 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider the 2018 Sewer Rent Rate. Section 1 – Purpose. Article 14-F of the General Municipal Law authorizes the imposition of sewer rents as a means of raising funds (a) to operate, maintain and repair a municipal sanitary sewer system, and (b) where not prohibited by General Municipal Law § 453 (3), to expand such system. This law creates a sewer rent to be imposed upon the properties that discharge sewage into the Town of Mamaroneck’s sanitary sewer system. The rents will be used to operate, maintain and repair that sewer system and if deemed appropriate by the Town Board and not prohibited by General Municipal Law § 453 (3), to expand such system. The Town Board finds that a sewer rent more equitably distributes the cost of the sanitary sewer system because it is a function of usage computed based upon water consumption and is charged to all the users of that system, including tax exempt properties. PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be given an opportunity to be heard and that all persons are invited to submit written comments at or prior thereto. On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously closed. On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, it was unanimously RESOLVED, that the Mamaroneck Town Board sets the Sewer Rent Rate for 2018 at $.00066 per gallon. The above resolution was put to a roll call vote: Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye PRESENTATION – Town Sustainability Collaborative Presenters: Mitch Green, Chair of the Sustainability Collaborative and June Wallach Sustainability Collaborative Volunteer Mitch Green’s presentation included highlights of 2017 Sustainability Collaborative activities, highlights of the Sustainability Collaborative Retreat on November 18, 2017, as well as goals, programs and budget for 2018. SUPERVISOR’S SUMMARY REPORT I know the changes resulting from the new federal tax law are of concern to many residents. We have received several calls from residents interested in prepaying their taxes. There has been extensive discussion among municipal officials and with our state representatives to determine if it’s possible to prepay 2018 Property Taxes. Municipal governments cannot collect property taxes unless they are approved by the municipal board. The tax warrant for the Town of Mamaroneck is completed in March for an April collection. It is not possible to move up the schedule because we could not generate the necessary information in that time and the computer software that determines the taxes and creates the tax bills could not be reconfigured and reprogrammed in that time. Under New York State law, the Town is not permitted to generate a tax bill nor collect taxes without a tax warrant. Therefore, we are not permitted to collect any prepayment of the Town Tax Bill. Under New York State Tax Law, the Town is only permitted to collect a prepayment of the second installment of the 2017-18 School Taxes without a tax warrant. Some cities and villages already had January tax collection schedules so they already had a tax warrant approved and could take advantage of the early payment. Most Towns in Westchester County could not. 5 December 20, 2017 If you wish to prepay the second half of the 2017-18 School Taxes in 2017, be sure the Town of Mamaroneck Tax Receiver receives payment on or before December 31, 2017, or the transmittal of payment is postmarked on or before December 31, 2017. The Town Board passed the 2018 budget under the state mandated tax cap with a 2.63% tax levy increase at the last TB meeting. The budget is available on the Town website. There is a change in the sanitation pick up schedule due to the holidays. There will be no garbage th pickup on Monday December 25 and Monday January1st. Maxwell Avenue Recycling Center will th be open the Saturdays before the actual holidays, December 23rd and December 30. We are proud and pleased of the TMFD and TMPD and thank them for running Toys for Tots programs. We have had some wonderful holiday events in the community the past two weeks. This is Councilman Ernie Odierna’s last meeting as a Councilmember. He has been a valuable and appreciated member of the Town Council for 18 years. We had retirement party for Ernie Odierna last week where leaders of the community praised him and thanked him for his service. We will miss him. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Odierna, the Board of Fire Commissioners was unanimously declared open. NOW, THEREFORE, BE IT RESOLVED, that the Mamaroneck Board of Fire Commissioners does hereby award Contract TA-17-07 Fire Headquarters Apparatus Floor Replacement, to the lowest responsible bidder meeting all of the Town’s requirements, to Specialty Construction Service, at a total cost of $1,135,000, to reinforce the apparatus floors at the Fire Headquarters, and BE IT, FURTHER 7 December 20, 2017 RESOLVED, that the Town Administrator is hereby authorized to execute said contract on behalf of the Town. There being no further business to come before the Commission, on motion of Commissioner Odierna, seconded by Commissioner Elkind Eney, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Authorization – Renewal Agreement – GAR Associates On motion of Commissioner Odierna, seconded by Commissioner Elkind Eney, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the Agreement with GAR Associates to provide assessment roll maintenance services, for the years 2018, 2019 and 2010, at a total cost of $305,000, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Salary Authorization – Appointment of Building Inspector On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, it was 8 December 20, 2017 RESOLVED, that the Mamaroneck Town Board does hereby appoint Richard Polcari as Building Inspector effective, no later than, January 31, 2018, at an annual salary of $113,000, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute the employment agreement on behalf of the Town. Salary Authorization – Appointment of Police Chief On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, it was RESOLVED, that the Mamaroneck Town Board does hereby appoint Paul Creazzo to the position of Police Chief, effective January 1, 2018, at an annual salary of $170,000, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to sign the employment agreement on behalf of the Town.
