HomeMy WebLinkAbout2017_09_19 Town Board Minutes September 19, 2017 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON SEPTEMBER 19, 2017, BEGINNING AT 5:00PM IN CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Work Session was unanimously opened at 5:00PM. Review – Zoning Petition – Gjoko Spa & Salon 176 Myrtle Boulevard Additionally Present: Gjoko Shkreli owner of Gjoko Spa & Salon and his son Niko Shkreli, David Cooper and Kate Robert of Zarin & Steinmetz The Town Board previously received submission of a Petition for a Zoning Text Amendment for 176 Myrtle Boulevard. Supervisor Seligson asked Mr. Maker to advise the Town Board on how to approach this document. Mr. Maker stated that the Town could start by referring it directly to the Planning Board for a report, which would be due within 45 days of the referral. Or the Town Board could reject the petition outright. The Board could also table the petition in order to gather more information on parking – taking into account the changes that have taken place in the area since the last study was completed. Supervisor Seligson stated that the petitioner knows and understands that the most important and difficult part of this application is the parking. Supervisor Seligson does think that moving forward with an updated study would be helpful to determine if the Town can entertain such an application. Mr. Altieri did make an initial inquiry to Frank Fish and was told that it would take approximately eight weeks for a study to be completed. This would assume using the previous study as a footprint. Mr. Cooper stated that it would be amenable to the applicant to extend the 45 day requirement, in order to give the Town time to complete the parking study. Mr. Altieri will contact Frank Fish to determine a cost proposal before the next Town Board Meeting. The Town Board will await the parking study before referring the petition to the Planning Board. Consideration – Special Permit Requirement – Cambium The Town Board took up the matter again with respect to Section 6D of the Special Permit approval for the Cambium, which references the façade of the commercial component of the project. The Town Board reviewed a rendering that had no arches or canopies. The Town Board reiterated their desire for something more in line with the proposal previously presented, that had architectural arches, similar in style to the façade of the Cambium. Mr. Altieri will go back to the developer and ask for a proposal that is a compromise between the current proposal and the proposal with the arches. Mr. Altieri will also ask the th developer to come to the worksession on October 4. 1 September 19, 2017 Consideration – LMC-TV – Funding of Proposed New Headquarters The Town Board reviewed a proposal from Leon Potok Village of Mamaroneck Trustee, addressing financing alternatives for the LMC-TV facility consolidation. It was noted by the Town Board that this is not an official alternative, and the financial parts should be verified against the numbers that were presented to the Town Board by the LMC-TV Board of Directors. ADDED ITEM Councilwoman Elkind Eney stated that she was contacted by a resident of Colonial Avenue regarding consideration of a sidewalk on Colonial Avenue. The Town Board asked Councilwoman Elkind Eney to report back to the resident that the Town Board will visit the street and review it. Consideration – Lease of Electric Vehicles The Town Board reviewed a memo from Mr. Altieri dated September 15, 2017, outlining a proposal to lease two Nissan Leaf electric cars. Mr. Altieri’s memo outlined the Town’s evaluation of opportunities to introduce electric vehicles into the Town’s vehicle fleet. Mr. Altieri further explains that until recently, other than the environmental benefits of an electric vehicle, the economics of electric vehicles has not been favorable. Approval of the lease is on the regular agenda for this evening. Discussion – Right of Way Encroachments Mr. Altieri brought to the Town Boards attention that the homeowner on Homer Avenue received a violation for having a basketball hoop in the Road, causing a right of way encroachment. The Town Court fined him $150.00, and required the removal of the basketball hoop. The resident of Homer Avenue demonstrated to the Town multiple instances where other homeowners had basketball hoops in the right of way. In order to not spot enforce, the Town will issue notices to the other homeowners requesting that the basketball hoops be moved out of the right of way. The Homeowner with the court order will need to comply as well. ADDED ITEM Supervisor Seligson stated that Safeguard Storage Facility is asking permission to plant landscaping in the Town right of way. Supervisor Seligson will notify Cuddy and Feder, the attorney for Safeguard Storage, and tell them that the Planning Board will make a determination. On motion of Councilman Murphy, seconded by Councilman Odierna, the Board unanimously agreed to enter into an Executive Session to discuss sale of real property. EXECUTIVE SESSION Sale of Real Property On motion of Councilwoman Katz, seconded by Councilman Murphy, the Board unanimously agreed to resume the Regular Meeting. Mr. Altieri gave an update on his recent meeting with the Humane Society of Westchester (formerly the New Rochelle Humane Society) as well as the recent accident on Fennimore Road in which a vehicle went out of control striking a Town Highway bucket truck. Fortunately no one was seriously injured, but the Town’s 2008 Highway vehicle sustained significant damage, and will need to be replaced. The Town will be receiving $150,000 from the insurance company. In the meantime the Town is trying to rent a replacement, or potentially borrow a vehicle from the Village of Larchmont. 2 September 19, 2017 CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this evening, adding this is an open meeting that all residents’ are welcomed to attend. SUPERVISOR’S SUMMARY REPORT We launched our food waste recycling program yesterday! You can now bring your food waste to 40 Maxwell Avenue, the Town Recycling Center, where it is collected and will be turned into nutrient rich garden compost. This is a program of the Larchmont/Mamaroneck Joint Garbage Disposal Commission and open to all residents in the unincorporated area of the Town and the Village of Larchmont. We are selling the $20 composting kits at the Recycling Center, Town Center and Larchmont Village Hall. We had a great article in the Journal News and LMC-TV will be airing a spot on the program this Thursday night. This program is a great way for people to participate in making a difference in their environment and to reduce waste. Several Town staff and Councilwoman Elkind Eney and I attended a Westchester County emergency tabletop exercise. Annually the County convenes leaders and emergency responders from the municipalities to practice the response to a contrived emergency. It is a good exercise for all of us to engage in as we face more severe weather events and hurricanes. I’m happy to report that the Town of Mamaroneck is well prepared. There have been lots of community events the past two weeks. We held our annual community th September 11 ceremony last week and had a large crowd of participants and attenders. Thank you to the PDs, FDs, ambulance district, veterans, girl scouts, boy scouts and all others who attended. I believe it is still helpful for us to come together as a community to recognize that fateful day. The annual Fall Cleanup was held at Hommocks Conservation Area Saturday morning. This effort is part of International Coastal Cleanup where we tabulate the items found and report them to data base that is used to better understand and curtail marine litter and debris. We had about 25 participants who collected about 120 pounds of garbage, 90 pounds of recyclables and 10 pounds of paper. Thank you to the students and families that participated. I attended many other events, but will let my colleagues mention them later in their remarks. Leave your car home or drive it less on Friday, September 22nd, 2017 Car Free Day is a free international event celebrated every September 22nd in which people are encouraged to get around without driving alone in cars and instead ride a train, bus, subway, bicycle, carpool, vanpool, or walk. For those that have the ability to work from home or drive an electric vehicle, EV’s and telework also counts. Car Free Day is open to anyone who lives or works in the Hudson Valley. Just go to www.carfreeHV.com to pledge. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board, and there was not. AFFAIRS OF THE TOWN 1.Set Public Hearing – Establish No Parking Zone at 1298 Palmer Avenue Residents’ of 1298 Palmer Avenue have come before the Town Board with concerns about vehicles blocking access to their driveway. The Town Board referred this to the Traffic Committee, and at this time the Town 4 September 19, 2017 finds that there is a need to eliminate some of the parking spaces in the vicinity of 1298 Palmer Avenue in order to improve safety for ingress and egress into and out of the property of 1289 Palmer Avenue. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on a “Restriction on Parking on a Section of the South Side of Palmer Avenue in the vicinity of 1298 Palmer Avenue” Law, for October 4, 2017 at 8:00PM at the Town Center, 740 West Boston Post Road, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 2.Consideration – Special Permit Requirement Cambium Deferred 3.Authorization – Transfer of Funds – Repairs – Senior Center Building Per the memo from Mr. Altieri dated September 15, 2017, the Town discovered a natural gas leak at the Senior Center Building. Mr. Altieri’s memo outlined the repairs that need to be made and their costs. On motion of Councilwoman Katz, seconded by Councilman Odierna, it was RESOLVED, that the Mamaroneck Town Board does hereby authorize the budget amendment, and transfer of funds in the amount of $13,000 for the emergency repairs of the gas line at the Senior Center, as outlined by the Town Comptroller in the following schedule: BUDGET AMENDMENT - INCREASE 2017 GENERAL TOWNWIDE FUND BUDGET 9/19/2017 TOWN BOARD MEETING GENERAL TOWNWIDE (FUND A): INCREASE BUDGET: A.0000.5995 APPROPRIATED FUND BALANCE $ 13,000.00 A.6772.4012 BUILDINGS & GROUNDS REPAIRS/MAINT $ 13,000.00 * REPRESENTS ANTICIPATED USAGE OF GENERAL TOWNWIDE FUND UNRESERVED FUND BALANCE TO FUND THE EMERGENCY REPAIRS FOR GAS LINE AT THE SENIOR CENTER. On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was RESOLVED, that the Mamaroneck Town Board does hereby authorize the leasing of two Nissan Leafs at the total price of $398.00 per month, from Mike Albert Fleet Solutions of Cincinnati, Ohio BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to enter into a lease agreement with Mike Albert Fleet Solutions, subject to final approval of the form of agreement by the Town Attorney, on behalf of the Town.
