HomeMy WebLinkAbout1996_07_17 Town Board Regular Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK AND THE BOARD OF FIRE COMMISSIONERS HELD ON JULY 17, 1996 AT 8:15 PM IN THE COURT ROOM OF THE TOWN CENTER,740 W.BOSTON POST ROAD, MAMARONECK, NEW YORK, 10543 PRESENT: Supervisor: Elaine Price Councilman Paul A. Ryan Councilwoman Valerie M.O'Keeffe Councilman Barry Weprin Councilwoman Phyllis Wittner ALSO PRESENT: Patricia DiCioccio, Town Clerk Steven V.Altieri,Town Administrator Charlene Indelicato,Town Attorney CONVENE EXECUTIVE SESSION The Board convened into an Executive Session at 6:30 PM in an Executive Session to discuss personnel and the sale of property in Conference Room A of the Town Center. On motion duly made and seconded the Board adjourned at 7:30 PM to the reception in the lobby outside the Court Room in honor of outgoing Town Attorney,Steven Silverberg. CALL TO ORDER The Regular meeting of the Town Board was called to order by Supervisor Price at 8:20 PM, who then pointed out the location of exits. PUBLIC HEARINGS-Parking Prohibition -No Parking Here to Comer-Leafy Lane -Adoption of Revised Town Code The following notice was entered into the record: NOTICE IS HEREBY GIVEN that the Town Board of the Town of Mamaroneck,Westchester County, New York,will meet at the Town Hall,in Mamaroneck,New York,in said Town,on the 17th day of July, 1996, at 8:15 o'clock P.M., Prevailing Time,for the purpose of conducting a public hearing for the specific object or purpose of amending parking regulations on Leafy Lane, by amending Section 2(a)and Section 2(b)which will create a no parking zone on Leafy Lane. At said public hearing said Town Board will hear all persons interested in the subject matter thereof. The Administrator explained that this matter had gone before the Traffic Committee and they were recommending that the law be amended to restrict parking on the north side of Leafy July 17,1996 Lane for eighty-two from the Murray Avenue intersection; and on the south side of Leafy Lane for a distance of sixty-four feet from Murray Avenue. Then on motion of Councilwoman Wittner,seconded by Councilwoman O'Keeffe,the hearing was unanimously opened. Whereupon the Supervisor asked if anyone wished to speak either in favor of or against the local law. There being no comment,the hearing was closed on motion of Councilman Weprin,seconded by Councilwoman O'Keeffe. On motion of Councilwoman Wittner,seconded by Councilwoman O'Keeffe,the following local law was unanimously adopted: Local Law No. 15-1996 This Local Law Shall be known as "Parking Regulations Leafy Lane." Section 1. Purpose: The Purpose of this Local Law is to regulate parking on Leafy Lane in accordance with the recommendations of the Town of Mamaroneck Traffic Committee. Section 2.Regulations: a. There shall be no parking on the north side of Leafy Lane for a distance of eighty two feet from its intersection with Murray Avenue. b.There shall be no parking on the south side of Leafy Lane for a distance of sixty four feet from its intersection with Murray Avenue. Section 3.Signs to Be Erected: Signs shall be erected in the appropriate locations reading "No Parking Here To Comer" in order to implement the provisions of section 2 of this local law, Section 4. Severability: Should any provision of this local law be declared invalid by a court of competent jurisdiction such declaration of invalidity shall not effect any other provision of this local law which may otherwise be given effect. Section 5. Effective Date: This local law shall become effective immediately. PUBLIC HEARING -Adoption of Revised Town Code The following notice was entered into the record: PLEASE TAKE NOTICE that,for the purpose of adopting a codification of the local laws, ordinances and certain resolutions of the Town of Mamaroneck,said codification to be known -— as the"Code of the Town of Mamaroneck,"a public hearing will be held by the Town Board at the courtroom in the Town of Mamaroneck,on the 17th day of July..... 1996, at 8:15 p.m.,to consider the enactment of the proposed local law described as codification of the local laws, ordinances and certain resolution of the Town of Mamaroneck into a municipal code to be designated as the"Code of the Town of Mamaroneck: Copies of the local law described above and of the Code proposed for adoption thereby are on file in the office of the Town Clerk of the Town of Mamaroneck,where the same are available July 17, 1996 for public inspection during regular office hours. PLEASE TAKE FURTHER NOTICE that all interested persons will be given an opportunity to be heard on said proposed local law at the place and time aforesaid. The Town Attorney outlined the procedures followed in recodifying the law,saying that comments had been taken from all departments,volunteer boards and commissions. Old laws, such as the one dealing with regulating the keeping of swine,were eliminated and the code was reworded in many cases to non-genderize verbiage. The working document was then resent out to the same groups for comment and some were incorporated into the final document appearing before us for adoption this evening. It has taken many meetings,calls, and digging through new and old records to produce this document,which we believe to be an — improvement both in reading and in access. In addition,the Town Clerk has arranged for the Code to be computerized so that access is even more convenient. Supervisor Price moved that prior to opening the hearing,that the action be given a negative declaration. On motion of Councilman Ryan,seconded by Councilwoman Wittner,it was unanimously RESOLVED,that the Town Board does hereby declare the action of recodification as having a negative impact according to the laws outlined by Town and State Law. On motion of Councilman Ryan,seconded by Councilwoman O'Keeffe,the Public Hearing was unanimously opened. The Coastal Zone Management Commission(the"CZMC) discussed the Proposed Code Adoption at its meeting held on June 25, 1996. In,the opinion of the CZMC,the Proposed Code Adoption(Revised June 24, 1996)advances the policies Set forth in the Local Waterfront Revitalization Program(the"LWRP")and accordingly is consistent with the _ LWRP. Pursuant to the County Code,the referral is mandatory. Specifically,the County would review changes to our land use legislation.Attached is a correspondence from the County indicating there agreement with the proposed changes.In addition,the code was referred to the Town Planning Board for review. The Planning Board had no specific comments on the changes. Stephen V.Altieri Town Administrator July 12, 1996 Town of Mamaroneck Town Center, 740 West Boston Post Road Mamaroneck,NY 10543-3319 Re:MMT 96-004.Recodification of Mamaroneck Town Code Dear Mr.Altieri: Thank you for the notification concerning the following action:Project Name: Recodification of Mamaroneck Town Code Action(s):Zoning Ordinance Amendment Having reviewed this matter under the provisions of Section 239 L,M,and N of the General Municipal Law and Section 277.61 of the County Administrative Code,we find that this action is a matter for local determination in accordance with your community's planning and zoning policies. The proposed minor text changes to the Town's Zoning Ordinance appear reasonable in that they update the regulations so as to incorporate recent amendments of New York Law,to reflect current planning standards and to address identified problems such as residential lot coverage. Thank you for calling this matter to our attention. Respectfully, WESTCHESTER COUNTY PLANNING BOARD Jerry Mulligan Deputy Commissioner Supervisor Price asked if anyone wished to speak either in favor or against the adoption of the code. -- Councilwoman O'Keeffe stated that the chapter on ethics she felt,should be revised allowing no more than three members to be of the same political party. Councilman Ryan disagreed,responding that by knowing the enrollment of potential members before appointments would make it political,where up to now,it had never been an issue. On motion of Councilman Ryan,seconded by Councilwoman Winner,the hearing was closed and the Code was unanimously adopted. 4 July 17, 1996 PROPOSED LOCAL LAW NO. 1996 A LOCAL LAW TO PROVIDE FOR THE CODIFICATION OF THE LOCAL LAWS, ORDINANCES AND CERTAIN RESOLUTIONS OF THE TOWN OF MAMARONECK INTO A MUNICIPAL CODE TO BE DESIGNATED THE"CODE OF THE TOWN OF MAMARONECK" This local law: (1)States the legislative intent of the Town Board in adopting the Code. (2)Provides for the designation of the local laws,ordinances and certain resolutions of the Town of Mamaroneck as the"Code of the Town of Mamaroneck." (3)Repeals local laws and ordinances of a general and permanent nature not included in the Code, except as provided. (4)Saves from repeal certain local laws and ordinances and designates certain matters not affected by repeal. (5)Retains the meaning and intent of previously adopted legislation. (6)Provides for the filing of a copy of the Code in the Town Clerk's office. (7)Provides for certain changes in or additions to the Code. (8)Prescribes the manner in which amendments and new legislation are to be incorporated into the Code. (9)Requires that Code books be kept up-to-date. (10 Provides for the sale of Code books by the town and the supplementation thereof. (11)Prohibits tampering with Code books,with offenses punishable by a fine of not more than two hundred fifty dollars($250.or by imprisonment for not more than fifteen(15)days,or both. (12)Establishes severability provisions with respect to the Code generally. (13)Provides that the local law will be included in the Code as Chapter I,Article I. GRAND TOTAL 715.00 3000.00 700.00 July 17, 1996 The original total for the fire claims was$1418.07 under operating fund,that total was reduced by 831.00 when Councilwoman O'Keeffe asked for a further explanation as to why Mr.Cioffi was being paid that amount. Mr.Altieri said he would check into it,the claim was removed, so the Grand total was also reduced from$14,833.07 to 13,002.07. Out of Order 3. Monthly Report Commissioner Weprin read the fire report for the month of June 1996 The following report outlines responses to calls made during the month of June 1996. It summarizes the nature and origin of the calls,the number of men responding and the total time spent at,fire calls. Resolution-Submit Proposition to Referendum-Purchase of Aerial Ladder Truck. The following communication was received by the Town Clerk from the Fire Department and was read into the record. Town Clerk f Pagel The Town of Mamaroneck Fire Department needs to replace its ladder truck. Ladder 19 is a 1971 American La France 100 It rear mounted aerial ladder truck By industry standards Fire Service Apparatus have a maximum service life of 20 years.Ladder 19 is currently 26 years old,and delivery time for a new vehicle is estimated at 12 to 15 months. 9 July 17,1996 The condition of Ladder 19 is very poor. There is severe rust throughout the vehicle;interior as well as exterior. The area under the diamond plate on the ladder bed has lifted and buckled. Upon last inspection by Underwriters Laboratory,stress fractures were noted along the 100 ft, ladder,many mechanical parts are no longer commercially available and must be manufactured as needed. The repair bills have been numerous. In addition to the 100 ft.aerial ladder,Ladder 19 also carries required ground ladders and specific search and rescue equipment. An equally important function of the ladder is the ability to use the "water way" which is a hose running up the length of the ladder through which,water is pumped from an engine,thereby providing a source of water to many of our high rise buildings such as. Chatsworth Gardens,Larchmont Acres, Washington Square Apartments,Alden House 1299 Palmer Avenue,Larchmont Gables, The Carlton House, The Avonmore,Stonecrest; 172 Myrtle,and the Larchmont Hills Apartments. The Insurance Service Office(ISO)is the organization responsible for rating fire departments.Since 1973 population is no longer a criteria;however,it does rate us on things such as square footage and density of dwellings afforded fire protection;adequate number Of engine and ladder companies;fire flow(the ability to deliver a specific amount of water to the fire scene including the upper floors of high rise buildings);staffing;and distance traveled from the fire station (the Weaver Street Fire Station is centrally located in our Fire District). Our two (2)furthest travel distances are Stonewall Lane(3.5 miles)and Premium Point (3.3 miles). Our current ISO rating is based on their recommendation of 3 miles, and would surely be effected by greater travel distances. At the top of our"HIGH PRIORiTYRiSKS"are the four schools within.the fire district Hommocks 20,000 sq. ft 3 stories Central 84,000 sq. & _ 3 stories — Murray Avenue 63,000.sq. ft. 3 stories Sts.John&Paul 30,000 sq. ft: 2 stories Attached is a survey of the Town of Mamaroneck Fire Department apparatus along with a list of neighboring Sound Shore departments. N-w the Big Question: Why do we need a new ladder now? it is undisputed that Ladder 19 has well exceeded its life expectancy.Parts are no longer readily available to Fiz it,and"The Old Gray Mare-Ain't What She Used To Be." Our decision to replace Ladder 19 with one of a similar type(aerial ladder)is based on our potential need to evacuate many people quickly:school children, apartment dwellers,and Firefighters during roof operations,as well as a means of delivering water to the top floors of our high rise buildings. The question has been raised about sharing equipment with the Village of Larchmont. Larchmont's Tower Ladder serves a different function. The bucket is designed to be more articulate,however it only allows for 1 or 2 passengers to be raised or lowered to the ground at one time, which is ideal for Larchmont's population of older residents. The Town of Mamaroneck Fire Department and the Larchmont Fire Department currently have a long standing automatic response mutual aid agreement whereby during school hours and other peak times, each department responds with their ladder to all Fire alarms at schools in both the Town and Larchmont and 24 hours to the Manor Inn. 10 July 17,1996 It should be noted that Pelham and Pelham Manor have a similar agreement Mamaroneck Village,Rye,New Rochelle,and Scarsdale all respond with 2 of their own ladders to similar calls. We hope that this information has addressed any concerns that you may have, and we look forward to your support in the bond referendum. A RESOLUTION AUTHORIZING THE PURCHASE OF AN AERIAL LADDER FIRE TRUCK, INCLUDING ORIGINAL EQUIPMENT AND INCIDENTAL EXPENSES IN CONNECTION THEREWITH, FOR THE MAMARONECK FIRE DISTRICT NO. 1 IN THE TOWN OF MAMARONECK,WESTCHESTER COUNTY,NEW YORK,AT A MAXIMUM ESTIMATED COST OF$500,000,AND AUTHORIZING THE ISSUANCE OF$500,000 SERIAL BONDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF. WHEREAS,all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act,have been performed; and WHEREAS,it is now desired to authorize the financing of such capital project; NOW,THEREFORE, BE IT RESOLVED,by the Board of Fire Commissioners of Mamaroneck Fire District No. 1 in the Town of Mamaroneck,Westchester County, New York(the"Fire District"), as follows: Section 1. The purchase of an aerial ladder fire truck,including original equipment and incidental expenses in connection therewith, a specific object or purpose,for Mamaroneck Fire District No. 1 in the Town of Mamaroneck,Westchester County, New York, is hereby authorized at a maximum estimated cost of$500,000. Section 2. The plan for the financing of such specific objector purpose shall be by the issuance of$500,000 serial bonds of said Fire District, hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is twenty years, pursuant to subdivision 27 of paragraph a of Section 11.00 of the Local Finance Law. Section 4. The faith and credit of said Mamaroneck Fire District No-.l in the Town of Mamaroneck,Westchester County, New York,are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable.An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year.There shall annually be levied on all the taxable real property in said Fire District,a tax without limitation as to rate or amount sufficient to pay the principal of and interest on,such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law,the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized,including renewals of such notes, is hereby delegated to the Fire District Treasurer,the chief fiscal officer.Such notes shall be of such terms,form and contents,and shall be sold in such manner,as may be prescribed by said Fire District Treasurer,consistent with the provisions of the Local Finance Law: 12 July 17,1996 Section 6. Such bonds shall be in fully registered form and shall be signed in the name of Mamaroneck Fire District No. 1 in the Town of Mamaroneck,Westchester County,New York,by the manual or facsimile signature of the Fire District Treasurer and a facsimile of its corporate seal shall be imprinted or impressed thereon and may be attested by the manual or facsimile signature of the Fire District Secretary. Section 7. The powers and duties of advertising such bonds for sale,conducting the sale and awarding the bonds, including private sale of the bonds,are hereby delegated to the Fire District Treasurer,who shall advertise such bonds for sale, conduct the sale,and award the bonds in such manner as he or she shall deem best for the interests of the Fire District; provided,however,that in the exercise of these delegated powers, he or she shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds.The receipt of the Fire District Treasurer shall be a full acquittance to the purchaser of such bonds,who shall not be obliged to see to the application of the purchase money. Section 8. All other matters,except as provided herein relating to such bonds, including determining whether to issue such bonds having substantially level or declining annual debt service and all matters related thereto,prescribing whether manual or facsimile signatures shall appear on said bonds, prescribing the method for the recording of ownership of said bonds,appointing the fiscal agent or agents for said bonds,providing for the printing and delivery of said bonds(and if said bonds are to be executed in the name of the Fire District by the facsimile signature of its Fire District Treasurer,providing for the manual countersignature of a fiscal agent or of a designated official of the Fire District),the date,denominations, maturities and interest payment dates,place or places of payment, and also including the consolidation with other issues,shall be determined by the Fire District Treasurer. It is hereby determined that it is to the financial advantage of the Fire District not to impose and.collect from registered owners of such serial bonds any charges for mailing,shipping and insuring bonds transferred or exchanged by the fiscal agent,and,accordingly,pursuant to paragraph c of Section 70.00 of the Local Finance Law, no such charges shall be so collected by the fiscal agent. This project was proposed in our 1996 Report on Capital Improvements. Previously;the WJWW has requested approval for the joint portion of the project that is within the City of New Rochelle. We are now seeking approval for the . portion exclusively within the Town of Mamaroneck. The WJWW estimates the total cost to the Town of Mamaroneck for the local improvement will not exceed$77,000. On motion of Councilwoman Wittner,seconded by Councilwoman O'Keeffe;it was RESOLVED,that the Town Board does hereby approve the LOCAL IMPROVEMENT of project No.A-1125,said plan relates solely to the cleaning and cement mortar lining of existing 6- inch water mains of that portion of Larchmont Woods which is in the Town of Mamaroneck,as recommended by John Hock, Manager of the Westchester Joint Water Works;and BE IT FURTHER, RESOLVED,that the Town Board does hereby approve the expenditure not to exceed$77,000 for the above-mentioned project. Another communication requested authorization for the remainder of the project that was outside the Town.
