MINUTES OF THE REGULAR MEETINGS OF

CONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order
by Supervisor Battalia at 7:00 P.M. in the Court-Room.
Present were the following members of the Board:

On motion by Councilman Lerman, seconded by Councilman
Amlicke, it was unanimously
RESOLVED, that this Board conduct a Work
Session with the Westchester County
Committee on the Homeless in Conference
Room A.
RECONVENE
At this time, on motion duly made and seconded, it was
unanimously resolved that the Regular Meeting be
reconvened.
CALL TO ATTENTION - Location of Exits
At this time, Supervisor Battalia pointed out to those
assembled the location of exits as required by law for
public gatherings.

On motion by Commissioner Amlicke, seconded by Commissioner
Lerman, the meeting was called to order by Commissioner
Battalia at 8:40 P.M. in the Court Room.

Commissioner Silverstone presented fire claims for
authorization of payment and on her motion, seconded by
Commissioner Chapin, it was unanimously
RESOLVED, that this Commission hereby

AFFAIRS OF THE TOWN
1. Reapportionment - Fenbrook Subdivision
William Maker, Jr., Esq. presented to the Board his request
for a further apportionment of Lot 18 and on motion by
Councilwoman Silverstone, seconded by Councilman Chapin
with Councilman Amlicke abstaining, the following
resolution was adopted:
WHEREAS, an application has been made
to apportion Lot 18 on the subdivision
map entitled "Subdivision Map prepared
for Fenbrook Associates situate in the
Town of Mamaroneck, Westchester County,
New York" made by Aristotle Bournazos,
P.C. on June 25, 1985 and filed in the
Office of the County Clerk of the County
of Westchester, Division of Land Records
on January 10, 1986 as Map No. 22175
("the MAP") between the owners of Lots
17 and 19 as shown on the MAP; and
WHEREAS, it appears that a section of
retention area Niunber 1 as shown on the
MAP extends into the southeastern corner
of Lot 19 and that a fifteen-foot wide
drainage easement runs through Lot 17
and parallel to its northern border; and
WHEREAS, a resolution by this Board is
required in order to amend the Tax
Assessment Maps of the Town of
Mamaroneck to reflect this partition;
— Now, therefore, be it

RESOLVED by the Town Board of the Town
of Mamaroneck that:
The partition of Lot 18 as shown on the
MAP whereby Mr. Joseph T. Maloney
conveys to Elizabeth A. McMillan all of
his right, title and interest in that
portion of Lot 18 lying north of the
"proposed partition line" shown on the
annexed survey made by Bohn and Bonacci,
P.C., dated May 15, 1986 be, and the
same hereby is, approved; and be it
further
RESOLVED, that the Assessor of the Town
of Mamaroneck correct the Town's Tax
Assessment Map to reflect this partition
upon presentation to him of a copy of
the deed whereby title is conveyed.
The question of the adoption of the foregoing resolution
was put to a vote, which resulted as follows:

2. Certiorari Proceedings
a. Rosenshein v. Town of Mamaroneck
Following the explanation of the Town Assessor, George
Derderian and his recommendation to the Board, on motion of
Councilman Amlicke, seconded by Councilman Lerman, it was
unanimously
RESOLVED, that in accordance with the
terms recommended by the Assessor, this
Board hereby authorizes the settlement
of certiorari proceeding - Rosenshein v.
Town of Mamaroneck - for assessment
years 1981 through 1985.
b. Ten Grand, Inc. (Pepe) v. Town of Mamaroneck
Following the Town Assessor's explanation and his
recommendation to the Board, on motion of Councilman
Amlicke, seconded by Councilwoman Silverstone, it was
unanimously
RESOLVED, that in accordance with the
terms recommended by the Assessor, this
Board hereby authorizes the settlement
of certiorari proceeding - Ten Grand,
Inc. (Pepe) v. Town of Mamaroneck - for
assessment years 1984 and 1985.
3. Appointments to CAC and CLM
Following the recommendation of Councilwoman Silverstone,
and on her motion, seconded by Councilman Amlicke, it was
unanimously
RESOLVED, that this Board hereby
appoints Susan Carpenter as a member of
the Conservation Advisory Commission for
a two-year term.
Following the recommendation of Councilwoman Silverstone,
and on her motion, seconded by Councilman Lerman, it was
unanimously
RESOLVED, that this Board hereby
appoints Steven Goldstein as member of
the Conservation Advisory Commission for
a two-year term.
Following the presentation by Councilman Lerman, and on his
motion, seconded by Councilman Amlicke, it was unanimously

RESOLVED, that the following persons be,
and hereby are, appointed as members of
the Coastal Zone Management Commission
for the terms so specified:
Arthur Katz, one-year term of office.
Dr. C. Alan Mason, one-year term.
Howard McMichael, Jr., two-year term.
Phyllis kTittner, two-year term.
- Shirley Tolley, three-year term.
For Chairman of the joint Coastal Zone Management
Commission, Supervisor Battalia recommended the appointment
of Robert Schoenberger and Mayor Curnin of Larchmont stated
that this was a very important step for both communities
and that Mr. Schoenberger would be appointed at their Board
meeting next Monday to serve a one-year term of office.
Supervisor Battalia then expressed her gratitude to
everyone who served on the Coastal Zone Management
Committee and thanked them for the outstanding job they
did.
Thereafter, on motion by Councilman Lerman, seconded by
Councilman Mdicke, it was unanimously
RESOLVED, that the Town of Mamaroneck
Coastal Zone Management Committee be,
and it hereby is, abolished;
and be it further
RESOLVED, that the Town of Mamaroneck
Coastal Zone Management Commission be,
and it hereby, established;
and be it further
RESOLVED, that Lawrence Lerman be, and
he hereby is, appointed as Liaison to
the Coastal Zone Management Commission.

4. Resolution re: Endorsement of Legislation on Court
Fees and Certiorari Proceedings.
Supervisor Battalia stated that there is a Bill pending
before Governor Cuomo which raises the court fee reim-
bursement from $5 to $10 and on motion by Councilwoman
Silverstone, seconded by Councilman Amlicke, it was
unanimously
RESOLVED, that the Supervisor and Town
Council do hereby urge the Governor to
approve the legislation which raises the
court fee reimbursement from $5 to $10;
and be it further
RESOLVED, that the Town Supervisor is
authorized to convey to the Governor the
request that he approve the above
legislation.

George Derderian, Tax Assessor, presented a brief review of
Assembly Bill 11684-A and after discussion, on motion by Councilwoman Silverstone, seconded by Councilman Lerman, it
was unanimously
RESOLVED, that the Supervisor and Town
-- Council do hereby urge the passage of
Assembly Bill 11684-A which is an Act to
amend the Real Property Tax Law in
relation to evidence in assessment
review proceedings;
and be it further
RESOLVED, that the Town Supervisor is
hereby authorized to write to the
Governor requesting his support of this
Bill.
5. Presentation by Larchmont Library
Re: Computer Equipment
Administrator Altieri stated that no one from the Larchmont
Library Board was available to attend the meeting and on
the request of Councilman Amlicke, the matter was adjourned
pending further information.
6. Adoption of Town investment Policy
Councilman Chapin requested this matter be deferred to the
next meeting.
7. Transfer of Funds - Computer Equipment
Administrator Altieri introduced Mr.
Ed Brown, of DB
Systems, Corp., who then explained the type of computer
equipment that was proposed for the Town. After a brief
dicussion, on motion by Councilwoman Silverstone, seconded
by Councilman Amlicke, it was unanimously
RESOLVED, that this Board hereby
authorizes the the transfer of funds in
the amount of $45,000 from the general
fund and the federal revenue sharing
fund to set up a capital project fund
for the purchase of computer equipment.

8. Request of NY/NJ Trails Conference
Administrator Altieri stated he received a letter from John
Varvayanis requesting permission to allow the New York -
New Jersey Trail Conference to blaze a trail through the
Town in order for them to form a continuous walking link
from New Rochelle to Saxon Woods Park and on motion by
Councilwoman Silverstone, seconded by Councilman Amlicke,
it was unanimously

RESOLVED, that authorization be, and it
hereby is, given to the New York - New
Jersey Trail Conference to blaze the
trails requested by them by the use of
discrete patches of Paint, no more than
2" x 2" in size, to be painted at eye
level on tree trunks at a fair distance
apart;
and be it further
RESOLVED, that should the New York - New
Jersey Trails Conference wish to blaze a
trail which at this time does not exist
within the Unincorporated Area, no such
trail may be blazed without the written
Permission of the Town of Mamaroneck.
9. Set Date for Public Hearing - Noise Ordinance
With a few modifications to be made in the Proposed Noise
Ordinance, and on motion by Councilman Lerman, seconded by
Councilman Amlicke, it was unanimously
RESOLVED, that this Board sets
Wednesday, September 17, 1986 at 8:15
P.M. as the date and time for a Public
Hearing on the Proposed Noise Ordinance;
and be it further
RESOLVED, that the Town Clerk be, and
she hereby is, authorized to publish in
The Daily Times, the Notice of said
Hearing as required by law.

10. Salary Authorization - Comptroller's Office
Recreation Department
Administrator Altieri requested permission to upgrade
certain positions in the Comptroller's Office and on motion
by Councilwoman Silverstone, seconded by Councilman
Councilman Amlicke, it was unanimously
RESOLVED, that the Raymond C. Bingham
be, and he hereby is, appointed as
Deputy Comptroller/Deputy Receiver of
Taxes, at an annual salary of $29,075,
retroactive to July 3, 1986;
and it be further
— RESOLVED, that Sandra A. Vanderslice be,
and she hereby is, appointed as
Assistant to the Comptroller, at an
annual salary of $26,625, retroactive to
July 3, 1986.
Recreation Department
On motion by Councilman Councilman Amlicke, seconded by
Councilman Lerman, it was unanimously

RESOLVED, that as provided for in the
1986 Town Budget, this Board hereby
authorizes the salary expenditures to
the following persons for the terms of
employment and at the rate of
compensation for each as set forth:
Laura LaMagna, Hommocks Pool, $5/hour
- Lifeguard, $7/hour Alternate Manager,
effective August 4, 1986; Anne O'Reilly,
Rec. Assistant, Adult Sailing $4/hour,
effective retroactive to July 7, 1986;
Brett Fajen, Temporary Office Help,
$3/hour, effective retroactive to July
14, 1986.
11. Authorization Re: Vacation Payment for
Building Inspector
Administrator Altieri explained that William Paonessa,
Building Inspector, is retiring August 29, 1986 under the
New York State Retirement System three-year incentive plan
and therefore unable to take his vacation time. Mr.
Altieri recommended to the Board that a lump-sum payment be
made to Mr. Paonessa in lieu of 32 vacation days and on
motion by Councilman Amlicke, seconded by Councilman
Chapin, it was unanimously
RESOLVED, that this Board hereby
authorizes that a lump-sum payment of
$5,344, in lieu of 32 vacation days, be
made to William Paonessa.
At this time, Supervisor Battalia expressed her thanks to
Gen Soriano, formerly of the Comptroller's Office, and to
Bill Paonessa for their long and dedicated service to the
Town and on motion by Councilman Lerman, seconded by
Councilwoman Silverstone, it was unanimously
RESOLVED, that a letter of thank you for
long and dedicated service to the Town
of Mamaroneck be written to Gen Soriano
and Bill Paonessa.

12. Request from the Junior League
to use Town Center.
Administrator Altieri stated that he received a letter from
the Junior League of Westchester on the Sound, Inc.
requesting permission to use the Town Center on Wednesday
evenings and Saturday mornings for training volunteers.
Councilman Aaicke suggested that only a one-year period of
time be permitted until a standard plan for the use of the
Town Center building can be implemented.
Thereafter, on motion by Councilman Amlicke, seconded by
Councilwoman Silverstone, it was unanimously

RESOLVED, that permission be, and it
hereby is, granted to the Junior League
of Westchester on the Sound, Inc. to use
the Town Center facilities on Wednesday
evenings and Saturday mornings for a
period of one year;
and be it further
RESOLVED, that a nominal charge for
custodial services, heat and/or air
conditioning will be imposed on the
Junior League for those Saturday
mornings and Wednesday evenings when
there are no regularly scheduled Town
meetings unless the preset thermostatic
temperature settings are agreeable.
13. Official Filing of the School Tax Warrant
On motion by Councilwoman Silverstone, seconded by
Councilman Chapin, it was unanimously
RESOLVED, that Town of Mamaroneck School
Tax Warrant for the Year 1986 be filed
as follows:

14. Request of Tam Clerk for Resolutions Re:
A. Approval of Polling Places.
B. Authorization to Request Waivers on Access to
Certain Polling Places.
C. Authorization for Publication of Legal Notices for
Election.
On motion by Councilwoman Silverstone, seconded by
Councilman Amlicke, the following resolutions were
unanimously adopted:
A. Approval of Polling Places.
RESOLVED, that in accordance with the
provisions of Section 4-104 and Sections
4-118 and 120 of the Election Law, this
Board hereby designates a place for each
Election District in the Town as sham
on the lists hereto attached, and
authorizes the publication in the Daily
Times, a Notice listing the places for
Primary Election, Local Registration and
General Election, briefly describing
each district location:

B. Authorization to Request Waivers on Access to Certain
Polling Places.

RESOLVED, that upon recommendation of
the Town Clerk, this Board agrees that a
waiver of Section 4-104 (1-1) of the New
York State Election Law should be
requested pending further negotiations
for changes in the location of
inaccessible polling places;
and it be
FURTHER RESOLVED, that the Town Clerk
be, and she hereby is, authorized to
convey said request for waiver to the
Westchester County Board of Elections.
C. Authorization for Publication of Legal Notices for
Election.
RESOLVED, that the Town Clerk be, and
she hereby is, authorized to publish in
The Daily Times, the Legal Notices of
said Election.
15. Request of POW-MIA Organization to Fly Flag
Administrator Altieri reported that he received a request
from the Vietnam Veterans of America, Westchester/Putnam
Chapter, for the Town to fly the Prisoner of War - Missing
in Action (PO -MIA) flag and on motion by Councilwoman
Silverstone, seconded by Councilman Amlicke, it was
unanimously
RESOLVED, that the Town Administrator
be, and he hereby is, authorized to
purchase a POW - MIA Flag together with
the necessary hardware for flying more
than one flag;
and be it further
RESOLVED, that said flag is to be
installed and flown in Memorial Park.

16. Report of Town Historian - Burton Meighan
Mr. Meighan presented the Board members with a copy of
EARLY TOWN RECORDS OF MAMAROkW, 1697 - 1881 and stated
that the Town Minute Book contained the oldest documents in
the State of New York. He added that this book never
received the Library of Congress Card and that he believed
history should be brought to the public's attention. Mr.
Meighan stated that a New York State grant paid for the
work that went into this book and that he would like to see
the book filed with the Library of Congress and that he
would also like to have the 400 undistributed copies of the
book circulated.
Mr. Meighan then presented the Town a $500 check from the
Historical Society in honor of the Town of Mamaroneck's
325th Anniversary and requested that some of the proceeds
be used to purchase a plaque honoring Dr. Mary English for
the tremendous contribution she made in the formation of
this book.
Supervisor Battalia thanked Mr. Meighan for his
presentation and then requested that Senior Councilman
Amlicke and Junior Councilman Chapin meet with Dr. English
and Mr. Meighan to discuss the possibilities of promoting
circulation of the book and look into having the book filed
with the Library of Congress.

17. Authorization to Commence Action
-- to Collect Unpaid Taxes

Attorney Silverberg recommended that the Board adopt the
Westchester County Tax Act which would allow the Town to
bring a civil action personally against a property owner
for non-payment of back taxes and on motion by Councilman
Amlicke, seconded by Councilman Chapin, it was unanimously
RESOLVED, that this Board hereby
authorizes the Town Supervisor to
commence civil actions personally
against delinquent taxpayers pursuant to
the Westchester County Tax Law.
APPROVAL OF MINUTES
The Minutes of the Regular Meeting of May 7, 1986 were
presented and on motion by Councilman Amlicke, seconded by
Councilman Lerman, were unanimously approved as amended.
The Minutes of the Regular Meeting of May 21, 1986 were
presented and on motion by Councilwoman Silverstone,
seconded by Councilman Lerman, were unanimously approved as
amended.
The Minutes of the Regular Meeting of June 4, 1986 were
presented and on motion by Councilwoman Silverstone,
seconded by Councilman Amlicke, were unanimously approved
as amended.
Action on the Minutes of May 29, 1986 and June 271 1986 was
tabled.

WRITTEN COMMUNICATIONS
There were no written communications to cane before the
Board at this time.
ORAL COMMUNICATIONS
At this time, Mrs. Dimitriadis, of the Town of Mamaroneck,
requested that the Board vote against incineration in the
Town because of the severe pollution problems it causes to
which Supervisor Battalia replied that she would ask
Counsel to the Town to place the matter on the top of his
list and she then suggested that a letter be written to
Hon. Diane Keane requesting that she implement a monetary
increase of the fines which are imposed upon violators.
REPORTS OF THE TOWN CLERK
Town Clerk, Patricia DiCioccio, presented the Building and
Plumbing Report for the month of July, 1986.
THE SUPERVISOR REPORTS
Supervisor Battalia requested permission to write a letter
to Congressman DioGuardi concerning revenue sharing and
after a brief discussion, on motion by Councilman Lerman,
seconded by Councilwoman Silverstone, it was unanimously
RESOLVED, that the Town Supervisor and
Town Council of the Town of Mamaroneck
do hereby urge the passage of the
General Revenue Sharing Program Bill
(H.R. 1400) that is to be presented to
the House for consideration;
and be it further
RESOLVED, that the Town Supervisor is
authorized to convey to our Congressman
the need for the continuance of Revenue
Sharing in our community.
ADMINISTRATOR REPORTS
Administrator Altieri reported on the intersection of
Murray, Myrtle and Chatsworth Avenues and stated that the
traffic moves well through the intersection but that there
was a problem for pedestrians crossing the street. He
added that a request was made to the State for a change in
signalization and they agreed to initiate the reprograming
of equipment to implement that phase but that they are not
recommending it because of possible vehicle traffic and
congestion.

Mr. Altieri continued that the State felt that the "No Turn
On Red" signs which were installed by the Town would help
pedestrians safely cross the streets but that if the Town
authorized them to proceed with the signalization change,
they would be be relieved of any further responsibility
regarding the possible traffic congestion.
Councilwoman Silverstone stated that in her opinion the
intersection functioned better than did before, but
commuters walking to the train and the elderly were still
having problems.
Councilman Amlicke suggested waiting to see if the new
signs worked instead of installing the four-way red light
system and Councilman Lerman requested that the Traffic
Committee investigate the problem to which Mr. Altieri
responded that there was insufficient time for the Traffic
Committee to review the situation and that if the State did
install the system and it was not feasible, the system
could be removed or deactivated.
Supervisor Battalia requested input from the Police
Department to which Councilwoman Silverstone stated that
that would not be satisfactory because the situation had to
be corrected.
Thereafter, on motion by Councilwoman Silverstone, seconded
L by Supervisor Battalia, the following resolution was
adopted by a roll call vote:
RESOLVED, that the Town Administrator
be, and he hereby is, authorized to
write a letter to New York State
Department of Transportation requesting
that a four-way red light system be
installed and activated at the
interesection of Murray, Myrtle and
Chatsworth Avenues;
and be it further
RESOLVED, that said letter will also
state that the Town of Mamaroneck will
bear the expense of deactivating such
traffic system when and if it deems it
necessary.
The question of the adoption of the foregoing resolution
was duly put to a vote which resulted at follows:

adjourned at 10:55 P.M. in remembrance of Henry Smith who
recently passed away, and that this Board recess into
Executive Session to discuss matters of litigation and
personnel.
