BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilman Ernest C. Odierna Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilman Thomas A. Murphy ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Assistant Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was unanimously opened at 5:00PM. 1. Larchmont Library – Village Center Management Additionally Present: Laura Eckley Library Director and Pamela Tillinghast Dubitsky Chair of the Library Board The Board continued the discussion of the proposal for the Library to assume responsibility for all aspects of the (Village) Center’s operation including scheduling, maintenance and utilities. The Village of Larchmont would pay for 10% of the operating costs for the Center which at this time is about $1,200 to cover their use of the building. The Board asked for confirmation on the amount of usage by the Village of Larchmont. Ms. Eckley and Ms. Dubitsky believe that the Library usage would increase with the Library managing the Village Center. 2. Capital Projects List The Town Board reviewed Mr. Altieri’s 2017 Capital Project Status Report dated May 13, 2017. Mr. Altieri stated that the Colonial Avenue project is not a Town priority, so if the grant is not received it will be removed from the schedule. 3. Review – Leaf Blower Violation Fine Schedule The Town Board reviewed Mr. Maker’s draft legislation. The Board confirmed their intention for the fine to be issued to the landscape company and not the employee. The Board clarified, and then 1 May 17, 2017 amended the fine schedule. Setting a public hearing on this legislation was added to the regular agenda for this evening. 4. Resolution – Green Light New York: Driving Together Coalition The Town Board reviewed the resolution and then agreed to move its approval to the regular agenda for this evening. 5. New Business thrd The Town Board discussed the summer meeting dates as tentatively, July 17 and August 23. The members will review their calendars and readdress dates at the next Town Board Meeting. Mr. Altieri explained the current status of the paving project for the Town Center lot. In order to pave nd the lot in one day the Town Center will be closed on Friday, June 2. In exchange the Town will hold additional hours the prior Tuesday, Wednesday, and Thursday. Mr. Altieri explained that this has been discussed and approved by the union. Mr. Maker reported that the closing took place last Friday on 59 Mohegan Road. Mr. Murphy reported on his attendance at the last LMC-TV Board of Control Meeting. LMC-TV is still negotiating with the Village of Mamaroneck on the terms of lease, with a final vote as to whether to move forward with a lease at the Fire House, or move forward with a lease at the Town Center is th expected by the LMC-TV Board of Control on June 19. The meeting continued outside the Courtroom. CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 PM, she then pointed out the location of the exits. PRESENTATION – Tribute to Former Supervisor’s Dolores Battalia and Caroline Silverstone for their Housing Accomplishments Supervisor Seligson welcomed everyone to this wonderful gathering and acknowledgment of the work Dolores Battalia and Caroline Silverstone have accomplished for affordable housing. Supervisor Seligson read the following Proclamations. 3 May 17, 2017 ON BEHALF OF THE TOWN BOARD, WE WOULD LIKE TO HONOR DOLORES A. BATTALIA WHO HAS WORKED FOR DECADES TO CREATE AND PROMOTE AFFORDABLE HOUSING THROUGH HER MANY EFFORTS: AS MAMARONECK TOWN SUPERVISOR, SHE CREATED AN URBAN RENEWAL ZONE THAT ENABLED THE TOWN TO PURCHASE THE LARCHMONT MOTEL ALLOWING FOR THE CREATION OF AFFORDABLE AND WORKFORCE HOUSING; AS A FOUNDER OF ICARE (INTERFAITH COUNCIL FOR AFFORDABLE RESIDENCE) AND AS A MEMBER OF THE MAMARONECK TOWN HOUSING AUTHORITY. ON BEHALF OF THE TOWN BOARD, WE WOULD LIKE TO HONOR CAROLINE SILVERSTONE WHO HAS WORKED TIRELESSLY TO CREATE AND PROMOTE AFFORDABLE HOUSING THROUGH HER MANY EFFORTS: AS MAMARONECK TOWN COUNCILWOMAN AND SUPERVISOR, WHERE THE TOWN OF MAMARONECK HOUSING AUTHORITY AND A HABITAT FOR HUMANITY HOME WERE CREATED DURING HER TENURE; IN HER ROLE AS BOARD MEMBER OF ICARE (INTERFAITH COUNCIL FOR AFFORDABLE RESIDENCE) AND AS A MEMBER OF THE MAMARONECK TOWN HOUSING AUTHORITY. State Assemblyman, Steve Otis presented Dolores Battalia and Caroline Silverstone with State Proclamations Former Town Supervisor, Valerie Moore O’Keeffe spoke in praise of the work Dolores Battalia and Caroline Silverstone accomplished over the years. Supervisor Seligson announced all the Officials present this evening to honor Dolores and Caroline. SUPERVISOR’S SUMMARY REPORT Westchester County celebrated Earth Day this past weekend at Kensico Dam. The Town of Mamaroneck Sustainability Collaborative was acknowledged at the Earth Day Awards Ceremony for exemplary efforts related to educating residents on waste reduction and recycling. A Sustainability Collaborative volunteer, Neha Dhanik, has been working to create a new product called a Recyclopedia. It’s like a dictionary where you can look up any item to learn how to reuse, recycle, donate or as a last resort throw it away. Neha has completed the research and programmed all the information. The Town now has to have the package formatted into a user-friendly booklet and web tool. It was great to accept the award with th Neha Dhanik. We held an Employee Recognition Awards lunch on May 9 where we honored those employees who have worked for the Town for 10, 15, 20, 25 and 30 years. 4 May 17, 2017 Lieutenant Paul Creazzo and Patrol Officer Bob Ashley were recognized for 30 years of service to the Town. I had the chance to quickly review the Town Board’s statement on immigration and the TMPD’s Standard Operating Procedures at the Summit program on immigration yesterday. The program was very well attended. I have a reminder from the Town Assessor’s office. All tentative assessment data will be st available online and in the Assessor’s office beginning June 1. All property owners will st receive an assessment notice by mail on or about June 1 even if the assessment remains unchanged. If you have not already done so, please take a moment to watch the video regarding revaluation and assessment updates on the Town’s website. CITIZEN’S COMMENTS Supervisor Seligson asked if anyone in the audience would like to address the Board on something other than this evening’s public hearings, and there was not. PUBLIC HEARING (S) – “Stop Sign at the intersection of Rockingstone Avenue and Forest Avenue” Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on May 3, 2017 a Public Hearing will be held on Wednesday, May 17, 2017 at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road, Mamaroneck, New York to consider: “Stop Sign at the intersection of Rockingstone Avenue and Forest Avenue” Law. Purpose For safety reasons, the Town Board finds that there should be a stop sign stopping eastbound traffic on Rockingstone Avenue where Rockingstone Avenue intersects with Forest Avenue. The full text of this law can be viewed on the website or copies can be obtained at the Town Clerk's office during regular hours, Mon-Fri, 8:30 AM to 4:30 PM, In June, July and August until 4:00 PM at 740 W. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK CHRISTINA BATTALIA TOWN CLERK Published: May 11, 2017 5 May 17, 2017 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was unanimously opened. Supervisor Seligson asked if anyone wished to comment on the proposed Local Law. Sonia Cronyn, of 242 Rockingstone Avenue, addressed the Board. Ms. Cronyn spoke of what she believes to be a dangerous intersection. She asked the Town Board to consider an additional stop sign in the opposite direction on Forest Avenue for traffic calming and speed reduction. Councilwoman Katz stated that the Police are part of the Traffic Committee and it was their recommendation that the stop sign be placed in this direction. Councilwoman Katz also clarified for Ms. Cronyn that stop signs are not recommended as traffic calming measure or for speed reduction. The Town Board will ask the Traffic Committee to review this area again for any additional recommendations based on the additional concerns addressed this evening. On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Public Hearing was unanimously closed. On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the following Local law was approved Local Law No. 5 - 2017 This local law shall be known as the “Stop Sign at the intersection of Rockingstone Avenue and Forest Avenue” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: For safety reasons, the Town Board finds that there should be a stop sign stopping eastbound traffic on Rockingstone Avenue where Rockingstone Avenue intersects with Forest Avenue. Section 2 – Regulation of Traffic on Rockingstone Avenue: Vehicles traveling east on Rockingstone Avenue shall be required to come to a full stop at the point where Rockingstone Avenue intersects Forest Avenue. Section 3 – Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of Rockingstone Avenue indicating where a full stop is required by this law. 6 May 17, 2017 Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Supervisor Seligson asked if anyone wished to comment on the proposed Local Law. Helen Waters, 1298 Palmer Avenue, addressed the Board. Ms. Walters stated that on the opposite side of the street, in front of her house, there are continued issues with parkers blocking her driveway. She sees this as, not only an annoyance, but a potential danger if she were not able to get out of her driveway. Additionally, she thinks the fines for this offense are too low, adding that the parking offense in Washington Square is $50.00, and this offense is only $15.00. The Town Board will also refer this to the Traffic Committee. Ms. Walters was asked to send an email to Mr. Altieri stating the issues. On motion of Councilwoman Elkind Eney, seconded by Councilman Odierna, the Public Hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following Local law was approved Local Law No. 6 – 2017 This local law shall be known as the “Restriction on Parking on Sections of the North Side of Palmer Avenue in the vicinity of 1299 Palmer Avenue” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The Town Board finds that there is a need to eliminate some of parking spaces in front of the multi-family building known as 1299 Palmer Avenue, Larchmont, NY in order to improve safety for right and left turns into and out of the building’s garage. This local law does that. Section 2 – Regulation of Parking on two sections of Palmer Avenue: (A)No motor vehicle shall be parked on the section of the north side of Palmer Avenue which begins at the boundary line between the Town of Mamaroneck and the Village of Larchmont and extends seventy (70) feet east from that point of beginning. (B)No motor vehicle shall be parked on the section of the north side of Palmer Avenue which begins at the point that is one hundred fifty (150) feet east from the boundary line between 8 May 17, 2017 the Town of Mamaroneck and the Village of Larchmont and extends one hundred seventy- five (175) feet east from that point of beginning. Section 3 – Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of Palmer Avenue indicating where parking is prohibited by this law. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Adoption of Bond Resolution and Call for Fire District Referendum The following resolution was offered by Commissioner Elkind Eney, who moved its adoption, seconded by Commissioner Murphy, to-wit: BOND RESOLUTION DATED MAY 17, 2017. A RESOLUTION AUTHORIZING THE ACQUISITION OF TURNOUT GEAR FOR THE MAMARONECK FIRE DISTRICT IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT AN AGGREGATE MAXIMUM ESTIMATED COST OF $250,000, AND AUTHORIZING THE ISSUANCE OF $250,000 SERIAL BONDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF. 10 May 17, 2017 WHEREAS, all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; NOW, THEREFORE, BE IT RESOLVED, by the Board of Fire Commissioners of Mamaroneck Fire District in the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. The acquisition of turnout gear equipment, including incidental expenses in connection therewith, in and for Mamaroneck Fire District in the Town of Mamaroneck, Westchester County, New York, is hereby authorized at a maximum estimated cost of $250,000. Section 2. SEQRA DETERMINATION/NEGATIVE DECLARATION: It is hereby determined that said class of objects or purposes is a Type II Action for purposes of the State Environmental Quality Review Act which, the regulations promulgated thereunder provide, will not result in any significant adverse environmental effect. Section 3. The plan for the financing of such maximum estimated cost is by the issuance of $250,000 serial bonds of said Fire District hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 4. It is hereby determined that the period of probable usefulness of the class of objects or purposes is twenty years pursuant to subdivision 27 of paragraph a of Section 11.00 of the Local Finance Law. Section 5. The faith and credit of said Mamaroneck Fire District in the Town of Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property in said Fire District, a tax without limitation as to rate or amount sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 6. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Fire District Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the 11 May 17, 2017 limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Fire District Treasurer, the chief fiscal officer of such Fire District. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such forth and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Fire District Treasurer shall determine consistent with the provisions of the Local Finance Law. Section 8. The validity of such bonds and bond anticipation notes may be contested only if: a) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or b) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or c) Such obligations are authorized in violation of the provisions of the Constitution. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. Upon this resolution taking effect, the same shall be published in full in the official newspaper of said Fire District for such purpose, together with a notice of the Fire District Secretary in substantially the form provided in Section 81.00 of the Local Finance Law. Section 11. This resolution is adopted subject to approval at a special election of said Fire District to be held on June 27, 2017. A RESOLUTION AUTHORIZING RECONSTRUCTION OF THE FLOOR OF THE FIRE DISTRICT HEADQUARTERS BUILDING AT 205 WEAVER STREET, IN LARCHMONT, NEW YORK FOR THE MAMARONECK FIRE DISTRICT IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, AT AN AGGREGATE MAXIMUM ESTIMATED COST OF $1,150,000, AND AUTHORIZING THE ISSUANCE OF $1,150,000 SERIAL BONDS OF SAID FIRE DISTRICT TO PAY THE COST THEREOF. WHEREAS, all conditions precedent to the financing of the capital project hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; NOW, THEREFORE, BE IT RESOLVED, by the Board of Fire Commissioners of Mamaroneck Fire District in the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. The reconstruction of the floor of the Fire District Headquarters building at 205 Weaver Street in Larchmont, New York, including original furnishings, equipment, machinery, apparatus, appurtenances and incidental improvements and expenses in connection therewith, in and for Mamaroneck Fire District in the Town of Mamaroneck, Westchester County, New York, is hereby authorized at a maximum estimated cost of $1,150,000. Section 2. An annual 13 May 17, 2017 appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all the taxable real property in said Fire District, a tax without limitation as to rate or amount sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 6. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Fire District Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Fire District Treasurer, the chief fiscal officer of such Fire District. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such forth and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Fire District Treasurer shall determine consistent with the provisions of the Local Finance Law. Section 8. The validity of such bonds and bond anticipation notes may be contested only if: a) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or b) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or c) Such obligations are authorized in violation of the provisions of the Constitution. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. 14 May 17, 2017 Section 10. The above resolution was put to a roll call vote: Murphy Aye Elkind Eney Aye Katz Aye Odierna Aye Seligson Aye 2.Resolution – Submission of Grant Application – Sewer System Improvements On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved, 20 May 17, 2017 WHEREAS, the Town of Mamaroneck, City of New Rochelle, Village of Larchmont and Village of Pelham Manor have previously entered into an inter-municipal agreement to work together on completing a Sewer System Evaluation Study and the subsequent sewer system repairs as a condition of an inter-municipal agreement with the County of Westchester, and WHEREAS, the Town of Mamaroneck has previously adopted a resolution to contract with GHD Consulting Service Inc. to perform a sanitary system evaluation survey of Town owned sanitary sewer pipes and manholes, and WHEREAS, GHD Consulting Service Inc. has presented preliminary sanitary system evaluation survey data that shows sanitary sewer pipes and manholes defects, and WHEREAS, New York State passed The Clean Water Infrastructure Act of 2017 that provides at least $150 million to fund an Inter-municipal Grant, with $30 million available in 2017 for the evaluation and repair of sanitary sewer systems. NOW, THEREFORE, BE IT RESOLVED, that the Town of Mamaroneck Town Board does hereby authorize GHD Consulting Service Inc. to prepare on behalf of the Town of Mamaroneck a joint grant application for grant funding under the Clean Water Infrastructure Act for the evaluation and repair of sewer system defects identified in the Sewer System Evaluation Study, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to submit such grant application and serve as the Town’s representative to execute any and all documents relating to the grant application. Resolution – Support Green Light New York On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the following was approved DRAFT RESOLUTION OF SUPPORT GREEN LIGHT NEW YORK RESOLUTION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK IN SUPPORT OF ISSUING DRIVER’S LICENSES TO NEW YORK STATE RESIDENTS REGARDLESS OF IMMIGRATION STATUS WHEREAS, many New Yorkers are denied access to driver’s licenses they urgently need in order to drive legally to places such as work, buy groceries, take their children to school, travel to appointments, attend religious worship, or take family members to hospitals in case of emergencies; and WHEREAS, many New Yorkers who cannot obtain drivers licenses because of their immigration status live in fear that they will be arrested during a routine traffic stop, and because they do not have a driver’s license they will be vulnerable to deportation and being separated from their families; and WHEREAS, licensing drivers improves public safety by increasing the likelihood that those driving on our roads are properly licensed, informed of our traffic laws, and operating a registered , inspected, and insured vehicle; and WHEREAS, licensed drivers are more likely to stay at the scene of an accident to aid police and emergency workers, exchange insurance information with other affected motorists, and licensed drivers who witness crimes will be more comfortable reporting them to the police and cooperating in investigations; and WHEREAS, allowing immigrants to obtain a driver’s license regardless of immigration status would mean an increase in revenue for New York State from license and registration fees; and WHEREAS, removing immigration status barriers to driver’s licenses will reduce the number of accidents involving uninsured motorists, leading to lower auto insurance premiums for all New Yorkers; and WHEREAS, there are twelve states across the United States that already provide access to licenses for all residents, regardless of immigration status, including our neighboring states of Connecticut and Vermont.
