MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON MAY 3, 2017, BEGINNING AT 5:00PM IN
CONFERENCE ROOM A AND CONTINUING AT 8:00 PM IN THE COURT ROOM OF THE

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Katz, seconded by Councilman Murphy, the Work Session was unanimously
opened at 5:00PM.
Update- Weaver Street Firehouse Project
Additionally Present: Fire Chief Paul Tortorella
Chief Tortorella gave an update on the replacement and reinforcement of the Fire Headquarters apparatus
bay floors. Before the Board this evening is an agreement with Grigg & Davis Engineers, P.C., for structural
engineering services. Grigg & Davis were previously retained to evaluate the condition of the apparatus
floors. The Town Board reviewed a memo from Mr. Altieri dated April 29, 2017 with an update of the
project. On the agenda for this evening’s Fire Commission is authorization to approve the construction
document phase of the engineering proposal submitted by Grigg & Davis, and a transfer of funds.
Additionally the Board discussed the upcoming referendum required for bonding of this project as well as
bonding for the new turnout gear.
Discussion- Ethics Code Disclosure Form
Mr. Maker stated that he has been contacted by the attorney for the Town’s Land Use Boards as well as by
the Chair for the Planning Board regarding the Disclosure Statement that employees, volunteers and
officials of the Town are required to complete, if they are in a sensitive position as outlined in the Town’s
Code of Ethics. Both of these individuals feel the Disclosure Form may be too broad and essentially unable

to be completed based on its broad nature. Mr. Maker elaborated, and then the Town Board asked that it
be reviewed by the Board of Ethics. Statutorily the Board of Ethics is empowered to create the form for the
Disclosure Statement.
The Town Board reviewed a memo from Mr. Altieri with an update of the recent meeting that he
and Supervisor Seligson had with Village of Larchmont and Library representatives “regarding the
ongoing discussion as to whether the Larchmont Library should assume responsibility for the
managing and maintenance of the Village Center.” The memo outlined how the arrangement
would be structured. The Town Board asked for backup detail to justify the 10% of operating costs
that the Village of Larchmont would pay for operation of the Village Center, and for clarification
on the types of functions that will be held in the Village Center. Specifically, the Town Board asked
whether they are Library functions or general community organization functions. The Town Board
also asked for clarification of who would pay for capital repairs and expenditures, noting that the
Town should not pay for capital expenditures for a building it does not own. These additional
questions will be discussed with the Village of Larchmont. Mr. Altieri will also find the original
agreement between the Town and the Village of Larchmont regarding the Library.
ADDED ITEMS
Supervisor Seligson noted that two senior class interns from Mamaroneck High School will begin
working with Neha Dhanik on the recycling directory termed the Recyclopedia. Neha has been
working on behalf of the Sustainability Collaborative to create the Recylcopedia. The directory
will be available in hard copy and on-line. Supervisor Seligson stated that the Town is being
recognized for the Recyclopedia by the County at its Earth Day event being held at Kensico Dam.
Supervisor Seligson reported that she met with New Rochelle City Manager Chuck Strome and
Westchester County Legislator, Catherine Parker, to discuss reconvening the Long Island Sound
Watershed Intermunicipal Council (LISWIC) to focus on the revised NYS DEC MS4 program.
Supervisor Seligson updated the Town Board on a recent outreach initiative regarding the ban of
plastic bags. The Town of Mamaroneck Sustainability Collaborative is kicking off the Reusable Bag
Initiative through a video contest to publicize the initiative.
Mr. Altieri stated that the Ice Rink has just been rented for the filming of a scene for HBO’s ”The
Divorce”.
Councilwoman Katz stated that the Sustainability Committee presented the bicycle lane proposal
to the Traffic Committee.
Discussion- Leaf Blower Regulations/Town Code Violations
The Town Board reviewed the Town’s fines schedule, as well as a memo from Mr. Altieri outlining a survey
of other local communities’ fines for noise/leaf blower violations. Currently the Town Law states fines not

to exceed $250.00. The Town Board would like to establish a minimum fine, and discussed what that
minimum should be. The Town Board asked Mr. Maker to draft legislation establishing the first offense at
$125.00, the second offence at $250.00 and the third and subsequent offenses at $500.00.
The Town Board agreed this was a good first step while they continue to research the reduced decibel level
blowers. Supervisor Seligson will send to the Town Board the research George Roniger completed on the
reduced decibel leaf blowers.
The Town Board received an update from Connie Green O’Donnell on her attendance at a recent forum
held by the New York State Department of State regarding the County-wide Shared Services Initiative, a
mandate that is part of the New York State Budget. Ms. O’Donnell detailed many of the specific
requirements placed on the County and the local municipalities with respect to this mandate. The Town
Board reviewed the Guidance Document issue by the State.
Request for Executive Session
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Board unanimously
agreed to enter into an Executive Session to discuss the sale of land at 59 Mohegan Road and 84 Iselin
Terrace.

RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Attorney to
proceed with eviction proceedings for 84 Iselin Terrace, and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute related documents on
behalf of the Town.
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Board unanimously agreed
to resume the Regular Meeting.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:15 PM, she then pointed out the location of the exits.

Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents’ are welcomed to attend.
PRESENTATION – Mamaroneck School Superintendent, Dr. Robert Shaps – Presentation of 2017/2018
School District Budget
Dr. Shaps gave a presentation of the Superintendent’s Proposed Budget for 2017/2018, including handouts
to the Town Board. Dr. Shaps also distributed a handout highlighting the budget at a glance. The school
th
budget vote will be held on Tuesday, May 16, and the Town Board encouraged all residents to come vote
to support our schools.
SUPERVISOR’S SUMMARY REPORT
We had many celebratory and successful events in the Town the past few weeks. The
Recreation Department held the annual Bunny Hop at which a record 258 people participated.
We had 45 people at the cleanup of the Hommocks Conservation Area on Earth Day including
students from many schools, the Lions Club, Walgreens staff and Town staff and Board. The
Sustainability Collaborative had a table at the Sheldrake Spring Festival where they sold rain
barrels, rakes and recycling bins. We celebrated Arbor Day with a tree planting ceremony at the

VFW on April 28. Local girl scouts and veterans joined us as we dedicated a plaque to the
veterans of VFW Post 1156 David Potts.
I had the opportunity to participate in the LWV program, Running and Winning, where female
high school student leaders meet with female elected officials to talk about running for office.
It’s wonderful to meet these exceptional young women. I also went to the At Home on the
Sound gala last night (with Jaine) where they honored Gene and Emily Grant who are really
local royalty.
The Town just received the good news that Westchester County will recognize the Town’s
Sustainability Collaborative with an award for education in recycling at the County’s Earth Day
th
celebration at the Kensico Dam on Saturday May 13. This award is the result of a new
initiative called the Recyclopedia that was supported by the Collaborative and implemented by
Neha Dhanik. It is a directory for recycling anything you can think of.
We have two MHS seniors working as interns for the next 4 weeks, Henry Harwood and Sam
Mollin. The SSES continues and there is a joint effort between the County and the 4
municipalities working on the sewers to study the consolidation of the sewer district under the
one operator. This could make the system run more efficiently and economically.
We have received several complaints of unleashed dogs on the Sheldrake and Colonial
Greenway trails. Please remember to leash your dog. The leash requirement is for everyone’s
safety and enjoyment of the trails. As nice as your dog might be, you must leash your dog for
young people, people who are scared of dogs and runners. The police will begin issuing
summons.

Finally, I will mention two upcoming events. The Coast Guard Auxiliary Base in Harbor Island

Park will have their base opening on Saturday May 6 at noon and the opening of the senior
citizen art show will be at the Larchmont Library on Saturday May 6th from 2:00 to 4:00.

WHEREAS, on April 20, 2017 the Town publically opened and read three (3) bids for Contract
TA-17-05 Road Resurfacing and related work.
NOW, THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby award Contract TA-17-05 – Road
Resurfacing and related work, to the lowest responsible bidder meeting all of the Town’s
requirements, ELQ Industries, to provide road resurfacing services at a total cost of $989,670.00,

the vicinity of 1299 Palmer Avenue” Law, for May 17, 2017 at 8:00PM at the Town
Center, 740 West Boston Post Road, and

13.Amendment- Retainer Agreement- Town’s General Counsel
On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, it was
RESOLVED, that the Mamaroneck Town Board does hereby approve the changes to the retainer
agreement with the Town’s General Counsel as outlined in the Town Administrator’s memo dated
April 29, 2017, and
BE IT, FURTHER
RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf
of the Town.

14.Authorization- Energy Performance Contract Audit
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was

Celtic Energy and the Town of Mamaroneck to conduct an audit of the Town’s Energy
Performance Contract with Honeywell Systems at the cost of $7,910.00.

PROCLAMATION
ARBOR DAY TREE CITY U.S.A. AWARD
WHEREAS, Friday, April 28, 2017 is recognized by the Town of Mamaroneck as Arbor Day, a
special day set aside for the celebration and planting of trees; and

WHEREAS, Two thousand seventeen marks the 25 year the Town of Mamaroneck has been
recognized as a “Tree City U.S.A.”, one of only 43 communities in New York State to have
attained the 25 year distinction named by the National Arbor Day Foundation. The Town of
Mamaroneck has taken its tree-care responsibilities seriously with an effective community
forestry program for a long time; and
WHEREAS, Trees make a world of difference in our communities. Trees have long been
recognized for the beauty and value they lend to homes, neighborhoods, parks and business
areas. At the same time, those trees conserve energy, help clean the air, protect rivers and
streams, and provide a home for wildlife in our towns and cities.
NOW, THEREFORE, BE IT RESOLVED that I, Nancy Seligson, Supervisor, and the members of the
Town Council of the Town of Mamaroneck urge all citizens to participate in programs and
activities designed to furthering the establishment of trees in our community and I hereby
th
proclaim that the Town of Mamaroneck has – for the 25 year – been recognized as a “Tree
City USA.”
IN WITNESS WHEREOF, I have hereunto set my hand and caused the seal of the Town of
Mamaroneck to be affixed this 28th day of April 2017.
