MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF
THE TOWN OF MAMARONECK HELD ON JANUARY 18, 2017, BEGINNING AT 5:00PM AT
THE VETRANS OF FOREIGN WARS POST 1156, 1288 BOSTON POST ROAD,

CALL TO ORDER - WORK SESSION
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Work Session was
unanimously opened at 5:00PM.
1. Town of Mamaroneck Cyber Security Policy
Additionally Present: Roz Cimino, IT Director
Ms. Cimino discussed how she formulated the policy. Specifically, and among others, she is following many
of the regulations of the NYS Office of Cyber Security. Ms. Cimino also suggests using this as a learning tool,
to ‘teach to the policy’. Ms. Cimino will send out training dates to all users.
2. Appointments to Boards and Commissions
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the Board unanimously agreed
to enter into an Executive Session to discuss appointments to Boards and Commissions, and employment
history of a particular person.

On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the Board unanimously agreed
to resume the Regular Meeting.
3. Goals and Priorities
The Town Board reviewed item by item, the updated 2016 and 2017 Goals and Priorities Schedules. The
remaining 2016, as discussed, will be brought over to the 2017 schedule. Mr. Altieri will prepare and
distribute a new updated 2017 list.
ADDED ITEM
Hillside Avenue Bridge
Supervisor Seligson and Steve Altieri explained that the NYS Department of Transportation has awarded a
$2.8 million grant to the Town of Mamaroneck, the Town of Rye and the Village of Mamaroneck for

reconstruction of the Hillside Avenue Bridge, in the Village of Mamaroneck. Since capital construction of
bridges is a Town function, the Town will spearhead the project, with involvement from the Village of
Mamaroneck.
4. Update on Procedure for Property Sale
Mr. Altieri advised the Board of the current plan for the sale of the Mohegan Road property. An open
house will take place about 10-14 days prior to the auction. The Town will act as broker and will not
contract with a realtor.
5. Energy Cost Impact – New York State Public Service Commission Nuclear Rate Subsidy
The Board discussed adopting a resolution to exclude the Town of Mamaroneck and other communities
that have adopted the Community Choice Aggregation green choice from paying a surcharge for the
support of upstate nuclear power plants. The communities that have adopted the green choice have
responded to the Governor’s renewing the Energy Vision policy by choosing a renewable energy source and
should not be subject to subsidizing nuclear power. The Town Board added approval of this resolution to
the regular agenda for this evening.
NEW BUSINESS
The Town discussed the outlawing of firearms legislation set this evening for a Public Hearing. The Town
has received public feedback, notably from David Berkowitz, an attorney for the National Rifle Association
(NRA) questioning whether the law goes too far. Specifically, the example of a resident carrying a legally
firearm walking through the Town owned parking lot would be in violation of this law. Mr. Maker advised
the Board that this may be a legitimate point. The Board discussed opening the public hearing, but not
voting on this legislation until the public comments are heard and possible changes are made to the
legislation.
Councilwoman Elkind Eney discussed the early morning swim program at the Hommocks Pool. There are
two groups, a Master’s Program and a Recreational Program. The early morning swim program is operating
at a deficit. The Recreation Commission is considering ending the early morning swim program. Members
of the early morning swim program have been vocal in their opposition to ending the program, and some
members have suggested that participants pay the added charges. Additionally, a Survey Monkey went out
to the program participants to ascertain their ‘appetite’ for added fees. The Recreation Commission will
discuss the results of the survey at their next meeting. Supervisor Seligson will call the vocal participants,
but the Board feels it’s best for the Commission to work through the process.
Mr. Altieri and Mr. Maker brought to the Town Board’s attention an issue with the amount of rent being
charged tenants in the Cambium who are renting under the affordable housing agreement. The Town
believes they are being charged too much. The Town has discussed measures if the Developer does not
comply. Mr. Maker has spoken to the Developer’s attorney advising them that their client is not in
compliance with the Covenant. Mr. Maker feels the attorney understood the seriousness and would make
this known to their client.
CALL TO ORDER - REGULAR MEETING
The Regular Meeting of the Town Board was called to order by Supervisor Seligson at
8:15 PM, she then pointed out the location of the exits.
Supervisor Seligson noted that the Town Board met for a worksession beginning at 5:00 o’clock this
evening, adding this is an open meeting that all residents’ are welcomed to attend.

SUPERVISOR’S SUMMARY REPORT
With the start of the New Year, and in a continuing effort to better communicate with you, I would
like to remind all Town residents to give us their email addresses and to sign up for Swift 911. This
will allow the Town to communicate with you about emergencies, weather, road closings,
programs, and important Town news. Please go to the website, www.townofmamaroneckny.org to
sign up.
The revised 2017 Sanitation Brochure was mailed out and you all should have received it at home.
We hope that the format makes it easier to read and find the information you’re looking for.
Unfortunately, we forgot to include three important collection efforts in the brochure. One is that
you can now recycle textiles, shoes and leather such as handbags and belts at the Recycling Center
at Maxwell Avenue. Secondly, the Furniture Sharehouse has a trailer at the Recycling Center for
your used furniture that meets their requirements. Thirdly, you can bring your used vegetable oil to
the Town Yard where it will used to heat the mechanics area of the shop. So, clothes, shoes, leather
goods, furniture and vegetable oil are all recyclable.
I’m happy to report that the Town and the Village of Mamaroneck and the Town of Rye, jointly
received a NY State Bridges grant for $2.8 million to repair the Hillside Avenue Bridge. The bridge is
in the Village of Mamaroneck, but according to State law, Towns are responsible for major repairs
of bridges in villages. The Hillside Avenue Bridge spans the boundary between the Town of
Mamaroneck and the Town of Rye in the Village of Mamaroneck. The whole arrangement is
terribly confusing, but the good news is that we received a large grant to fix it.
Sustainable Westchester held its annual member meeting today at the County Center that was well
attended. They presented updates on the Community Choice Aggregation or Westchester Power
program, the Municipal Solar Buyers Group, Solarize and Electric Vehicles. The Westchester Power
program has resulted in savings of over $1.5 million for Westchester County Con Ed territory
customers since the beginning.
CITIZEN’S COMMENTS
Supervisor Seligson asked if anyone in the audience would like to address the Board on anything other than
what is set for a Public Hearing.
Theodore Schultz, a resident of Alden Road addressed the Board. He questions why the Westchester Joint
Water Works cannot do on line billing. They have the technology to do drive by meter reading, they should
have ability for electronic billing. Supervisor Seligson stated she would make the Westchester Joint Water
Works aware of his comments.
PUBLIC HEARING – “Outlawing Firearms on or in Town-owned or Town-leased Property or Buildings” Law
The following Notice of Public Hearing is entered into the record as follows:
NOTICE OF PUBLIC HEARING
LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of
New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on January 9,
2017 a Public Hearing will be held on Wednesday, January 18, 2017 at 8:00 PM or as soon
thereafter as is possible at the VFW Lodge, 1288 Boston Post Road Larchmont, New York to
consider to consider: “Outlawing Firearms on or in Town-owned or Town-leased Property or
Buildings” Law.
The Town Board is aware of the sad reality currently plaguing our country of shootings, often
fatal, of innocent persons. While the Town Board recognizes that it cannot solve this problem, it
also recognizes that there is no need for persons, other than specific officers and personnel, to
carry firearms on, or in Town-owned or Town-leased property or buildings. This law makes it
illegal for persons, other than those permitted to do so by this law, to bring firearms onto such
property.

Supervisor Seligson stated that the Town has already received comments from the public, adding that this
is not a finished product at this point, and therefore, the Town Board plans to open the public hearing and
close it without voting on this legislation.
Supervisor Seligson asked those individuals who wish to speak, that they put their names down and the
Board will call them in order.
On motion of Councilwoman Eney, seconded by Councilwoman Katz, the Public Hearing was unanimously
opened.
Rich Ruggerio, of 105 Laurel Ave, mistakenly spoke regarding the Thompson Street & Laurel Avenue
legislation.
Garret Galimi, of 111 Laurel Avenue, believes in the Second Amendment and is opposed to this legislation.
Tom Heslin, of 39 Edgewood Ave, believes removing legal firearms from Town Buildings actually opens up
more dangers for the public.
Pat Coppolecchia, of 480 Mamaroneck Avenue, stated she is not a resident but works in the Village of
Mamaroneck. She had a number of objections/comments. She objects to Hommocks Park Apartments
inclusion in law, she believes this law is a violation of the Fourteenth Amendment.
Charles Deshensky, of 169 Mt. Pleasant Avenue, and present on behalf of retired Police Officers believes it
is absurd that retired Officers cannot carry in Town buildings.
Lisa Selvaggio, 4 Orchard Place, Harrison, questioned why a fully vetted individual who has passed
extensive clearance to carry firearms should be denied access to Town Buildings.
Aaron Woodin, of 25 Lake Street, White Plains, stated he was against this legislation for many of the reason
already mentioned.
Scott Sommaulk, President of Westchester County Firearms Owners Association (WCFOA). Mr. Sommaulk
read from prepared comments. In summary he stated that this legislation is very loosely written and
exposes the Town to a lawsuit if enacted.
Mark Lane, stated he and his children are sports shooters, his son competitively. Often his car has legally
registered guns when they travel to and from competitions, adding that all Town Roads are Town property,
so someone would be in violation simply for driving through town.
He also is a constitutional lawyer and he too stated that the law as written will open the Town up to
lawsuits.
Mario Muollo, Vice President of WCFOA, stated that this law is mostly about feelings, and his personal
opinion is it violates federal and state laws.
Joseph McElhinney, of 7 Judson Street, thinks this is ‘a feel good law’ that will not actually do any good,
adding there is a laundry list of shootings in gun free zones. Mr. McElhinney noted a book by John Lot
which makes the argument that the more guns you have in a community the less gun violence you have.
Robert DiVincenzo, Board Member of the WCFOA, reiterated many points made by previous speakers.
Mark Malloy, stated that this law is a quandary for legal gun owners in an area where established
municipal boundary lines are very often difficult to know.

Lou Zaccio, stated that however well-intentioned this law may be, it sets out to restrict the rights of legal
gun carriers.
The Town Board and the speakers discussed the legislative meaning of a ‘gun free zone’.
Supervisor Seligson stated that the Town will take all comments into consideration and determine if and
how the Town Board will go forward.
On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the Public Hearing was
unanimously closed.

On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Public Hearing was

Supervisor Seligson asked if anyone which to speak regarding this legislation.
Pat Allen, of 5 Copley Road addressed the Board. Ms. Allen first asked for clarification as to the location of
the accessible space, and how this came about. Ms. Allen is concerned that there is an overall lack of
parking and if more residents come forward with requests for parking, specifically more overnight, she
would not be in favor of that.
Tim Cannon, also of Copley Road, did not directly address the Board, but stated he agreed with Pat Allen’s
concerns.
The Town Board assured her Ms. Allen and Mr. Cannon that this was not the beginning of more overnight
parking on Copley Road. This addresses a need for an accessible parking space, one currently not provided
for on the street, or in the Alden Apartment parking lot.

On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the followed local law was
adopted:
Local Law No 2-2017
This local law shall be known as the “Creation of an Accessible Parking Space on Copley Road”
Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck as follows:
Section 1 – Purpose.
The purpose of this local law is to create an accessible parking space on Copley Road.
Section 2 – Creation of an accessible parking space on Copley Road
There shall be one (1) accessible parking space on the north side of Copley Road, located
approximately one hundred (100) feet from the intersection of Copley Road and Alden Road.
Section 3 – Signs to be erected and painting to be done
An appropriate sign or signs shall be erected on the north side of Copley Road indicating the
location of the accessible parking space. If deemed appropriate by the Superintendent of
Highways, the accessible parking space also may be painted to indicate the accessible parking
space.
Section 4 – Severability
Should any court of competent jurisdiction declare any provision of this Local Law invalid or
unconstitutional, such declaration of unconstitutionality or invalidity shall not affect any other
provisions of this Local Law, which may be implemented without the invalid or unconstitutional
provisions.
Section 5 – Effective Date
This Local Law shall become effective on the date that it is filed in the office of the Secretary of
State.

Matt McCauley, a resident of Laurel Avenue addressed the Board. Mr. McCauley was one of the residents
who originally brought this issue to the Traffic Committee. He thanked the Board for moving forward
with this Legislation.
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the Public Hearing was
unanimously closed.
On motion of Councilman Murphy, seconded by Councilwoman Elkind Eney, the following Local law was
approved:
Local Law No 3-2017
This local law shall be known as the “Restriction on Parking on Thompson Street and Laurel
Avenue” Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1 – Purpose:
Commuters continue to park on Thompson Street and Laurel Avenue to the detriment of the
neighborhood. To relieve that intrusion upon the peace and tranquility of the residents, the Town
Board has decided to prohibit parking for two hours per day (one hour in the morning and one hour
in the afternoon) on weekdays on these streets.
Section 2 – Regulation of Parking on Thompson Street:
(a)No motor vehicle shall be parked on the east side of Thompson Street between the hours of 10:00
AM and 11:00 AM (prevailing time) on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays of
each week.
(b)No motor vehicle shall be parked on the west side of Thompson Street between the hours of 2:00
PM and 3:00 PM (prevailing time) on Mondays, Tuesdays, Wednesdays, Thursdays and Fridays of
each week.
Section 3 – Regulation of Parking on Laurel Avenue:
(a)No motor vehicle shall be parked on the north side of Laurel Avenue from its commencement at
Thompson Street to its dead end between the hours of 10:00 AM and 11:00 AM (prevailing time) on
Mondays, Tuesdays, Wednesdays, Thursdays and Fridays of each week.
(b)No motor vehicle shall be parked on the south side of Laurel Avenue from its commencement at
Thompson Street to its dead end between the hours of 2:00 PM and 3:00 PM (prevailing time) on
Mondays, Tuesdays, Wednesdays, Thursdays and Fridays of each week.

Section 4 –Holidays excluded:
This law shall not apply on holidays.
Section 5 – Sign(s) to be Erected and Painting to be Done:
An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on
the surfaces of Thompson Street and Laurel Avenue indicating where and when parking is prohibited by this
law.
Section 6 – Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other
provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions.
Section 7 – Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

There being no further business to come before the Commission, on motion of Commissioner Murphy,
seconded by Commissioner Odierna, the Commission unanimously adjourned and the Town Board
reconvened.

1. Appointments to Boards and Commissions
BOARD OF ARCHITECTURAL REVIEW
On motion of Councilman Odierna, seconded by Councilwoman Elkind Eney, it was unanimously
RESOLVED, that Ken Ricci be reappointed as Member C of the Board of Architectural Review, and
BE IT FURTHER
RESOLVED, that Joseph Shein be reappointed as Member D of the Board of Architectural Review,
and

BE IT FURTHER
RESOLVED, that the foregoing appointments shall be effective (A) immediately upon the appointee
taking and subscribing the oath mandated by section 25 of the New York Town Law and (B) shall
expire on December 31, 2019, and
BE IT, FURTHER
RESOLVED, that Edward Jacobson shall serve as Chairperson of the Board of Architectural Review
for the year 2017.

Law section 899aa, NYS Cyber Security Policy P03-002, the Town of Mamaroneck Security
Policy and PCI Compliance Assessment Questionnaire D Attestation of Compliance for
Merchants, the Town of Mamaroneck is required to designate an Information Security Officer
to be responsible for the security of all electronic information;
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Mamaroneck hereby
designates Rosalind Cimino as Information Security Officer.

6. Declaration of Surplus Equipment
On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following was approved,
WHEREAS, pursuant to NYS Information Security Breach Act of 2005, NYS General Business
Law section 899aa, NYS Cyber Security Policy P03-002 and PCI Compliance Assessment
Questionnaire D Attestation of Compliance for Merchants, the Town of Mamaroneck is

WHEREAS, the Town of Mamaroneck Town Board has determined that these items, which are
listed on the attached schedule should be disposed of accordingly, either by sale or by payment
by the Town for disposal or by other means of disposal available to the Town.

authorizes the disposal of its outdated computers through the Town’s Sanitation’s services for
disposal into Westchester County’s E-Waste Recycling Program..
NOW, THEREFORE, BE IT FURTHER RESOLVED, that all physical hard drives will be removed and
disposed of as per NYS Cyber Security Policy P03-002 and the Town of Mamaroneck Security
Policy to protect the Town’s information assets.

9. Resolution – Opposing Public Service Commission Nuclear Subsidy Rate Hike
On motion of Councilwoman Elkind Eney, seconded by Councilman Murphy, the following was approved,
WHEREAS, the Town of Mamaroneck is one of 20 municipalities in Westchester County
that joined the Community Choice Aggregation (“CCA”) program (also known as Westchester
Power) managed by Sustainable Westchester Inc. under New York State’s Reforming the Energy
Vision (“REV”) strategy; and
WHEREAS, CCA allows Westchester municipalities to contract directly with energy
suppliers to realize bulk discounts on retail rates for their residents and small businesses, and to
choose power from non-renewable or renewable sources; and
WHEREAS, the Town of Mamaroneck along with thirteen other municipalities in
Westchester County further chose to purchase 100% renewable power under the CCA program
(the “CCA Renewable Option”); and
WHEREAS, as a result of these choices, individual residents and small businesses in the
Town of Mamaroneck, unless they specifically opt out of the program, promote the purchase of
100% renewable power paying additionally for Renewable Energy Credits (“RECs”); and
WHEREAS, the New York State Public Service Commission (PSC) under the Tier 3 portion
of orders issued on August 1, 2016 and November 17, 2016 (the “Tier 3 Rate Hike Orders”)
imposes rate hikes for Town of Mamaroneck residents and small business to support aging
nuclear plants; in essence paying RECs for nuclear energy; and
WHEREAS, there should be no subsidies for any generating plants including nuclear. If
plants cannot deliver electricity at a reasonable cost they should not be compensated by
taxpayers or ratepayers. In any event, the people and businesses of the Town of Mamaroneck
should not have to pay additional monies for subsidies, RECs, on nuclear power when they are
already paying additionally for RECs through 100% of their energy needs; and

WHEREAS, the Town of Mamaroneck has demonstrated to the fullest extent its support
for and commitment to REV and the State’s renewable energy goals. To require Town of
Mamaroneck ratepayers enrolled in the CCA Renewable Option to pay additional subsidies is
inequitable and is contrary to REV and the State’s focus on renewable energy.
NOW THEREFORE the Town Board of the Town of Mamaroneck hereby petitions the PSC
to exempt all Town of Mamaroneck and Westchester County ratepayers participating in the CCA
Renewable Option from the Tier 3.
BE IT FURTHER RESOLVED that the Supervisor is authorized and requested to issue this
Resolution as certified by the Town Clerk to Governor Andrew Cuomo, Chair Audrey Zibelman,
County Executive Robert Astorino, State Senator George Latimer and State Assemblyman Steve
Otis.
